“Referring to the legal appointment of the criminal act for which highly charged defendants are charged, this court claims as follows: According to Article 106, par.1, under 1.5 of KPRK, prosecution cannot be taken if three (3) years have passed from committing criminal acts punishable by more than one (1) year in prison. While, according to Article 107, par.8 of KPRK, it is specified that prosecution is prohibited in any case when double the time of prescription has passed. In the concrete case, according to the indictment, criminal acts were committed by the date 17,11,2015, and by the time of the conduct of alleged criminal acts, more than six (6) years have passed. So the court finds that in this criminal case the absolute prescription of prosecution has reached 17.11.2021.”, says the verdict of Judge Dandrim Arrini to take on March 21, 2022, provided by “Justice Vow”.

According to the ruling, the legal provisions, those affected for the implementation of the legal property demand have been instructed in regular legal-civil disputes.

In contrast, according to the initial indictment filed on March 15th 2018 by Pristina Constitutional Prosecutor Rexhep Selimi, Lah Brahimaj, Zafir Berisha, Ramush Haradinaj, Albanian Pantina, Time Kadrija, Daut Haradinaj and Visar Imer were charged with alongside Donika Kadaj-Bujupi, Pal Lekaj, Haxhi Shala and Ismajli at the entrance of the Parliament of the Republic of Kosovo, following a preliminary dispute in co-chair, in a group with the intent of officials' performance of official duties.

While, according to the indictment specified on March 13th 2018, for criminal work “preventing the official person from performing official duties” were charged only with Rexhep Selimi, Lah Brahimaj, Zafir Berisha, Ramush Haradinaj, Albanian Pantina, Time Kadrija, Daut Haradinaj and Visar Imer.

According to the indictment, until the injured police officials Ifus Xhemajli, Agron Haziri, Mehdi Kozhani, Rifat Gashi, Ali Berisha, Burim Joshi, Shaban Beqiri, Artan Osmani, Xhavit Selimi, Faik Mehmeti, Xhemajl Abdullah, Rafet Ibit Ibishi, Irfan Haziri, Ilir Selimi, Nazmi Kastari and Faik Kranqii have communicated the news with the words of Kosovo's <x0m> and that we should be accompanied by police station in order to arrest for the 1720th arrest, chief prosecutor issued by the Pristina Court for criminal prosecution, or other criminal prosecution's command, because of the Pristina criminal prosecution has been launched or criminal prosecution. These actions are said to have silenced official persons with Kurt's association to competent organs that have demanded his arrest.

With this, Rexhep Selimi, Lah Brahimaj, Zafir Berisha, Ramush Haradinaj, Albanian Pantina, Time Kadrija, Daut Haradinaj and Visar Imer were accused of criminal work committed in co-ordination “Pingim of the official person in carrying out official tasks” by Article 409, paragraph 2 concerning Article 31 of the Republic of Kosovo Criminal Code. /A Vow for Justice
