The INPO organisation has reacted to this, voicing deep concern for violating the principles of competition equality and meritocracy on the part of the Government of the Republic of Kosovo over the public competition for mayoral candidates and four members of the Procuration Account.

The government on December 10th, 2021, has announced competition for chairmanship and four members of the Procureing Organisation Board.

On January 12, 2022, according to decision No. 0354, the Government has established the Electoral Commission for recommending candidates for chairmanship and four (4) members of the Procuring Organising Board. A total of twenty-five (25) candidates have applied in this competition.

On January 2022, the Election Commission has submitted the work report to Government, where it has praised candidates who have applied. Candidates have been assessed and targeted taking into account work experience, the CV and the motivating letter. A total of twenty-two (two) candidates had passed this assessment, while three (3) were not even posted because they failed to meet the competition's demands, namely, one of them has offered no evidence of the outcome of the jurisdictional exam, one of them has no minimum work experience, and one has offered no certificate from the evidence against whom no criminal case is under way.

The Electoral Commission has compiled the list by twenty-two (two) candidates, scoring by scores of 8.8 points that the most successful candidate has been launched to 3.2 points, as long as the candidate has been launched by at least a percentage point. It is strange that at the end of the report, the Election Commission has expressed its concern over the quality of candidates that have been competing, and in line with this concern recommends to the Government that “see the possibility of the proposal of other candidates who may be better prepared for those positions”.

This is essentially the recommendation that Government rule out competition procedures and take candidates that subjectively think they are meritive and appropriate, without being subjected to any competition procedures at all. Following that recommendation, Government from twenty-two to two (10) candidate, select only seven (7) of them, while three (3) are put on the list without any competition procedure, sending a total of ten (10) candidates, from two (2) candidates for each position” respectively, the INPO response reported.

As Periscope reported, INPO has noted that the candidates sent to the Assembly are: The Handoqu Vedat, which is mostly assessed by the Electoral Commission, a total of 8.8 points, then aside three (3) candidates with 8.1, 7.9 and 7.7 points and nominated Faruk Rexaj with 7.4 points, then two more (2) candidates, one with as many points as the selected candidate, a total of 7.4 and 7.3, while recommended candidates Bujar Lusac with 7.1 points and Batisha Ibrahima with 6.8 points. Nine (9) candidates who, by the number of scores, were sided with 6.2, 5.6, respectively. 5.6, 5.3, 5.2, 5.2, 4.8, 4.6, and 4.2 points are recommended and recommended Dafina Gashi with 4.1 points, after which a 4-point candidate and two candidates are recommended, Vjosa Gradija Mejuani, with 3.6 points and Kimete Gashi with 3.2 points, respectively.

“While there were candidates on the list with almost twice as many points as selected candidates, the Government uses “discretion” recommended by the Election Commission and among the candidates it sends to the Assembly also list three (3) candidates without any competition procedure, respectively. Nita Bata, Mr. Milot Spahiu and Mr. Arbnor Tmava”, thuhs away in the INPO statement.

INPO through request for access to public documents has requested application documentation for all candidates who have competed, including the relevant documentation of three (3) candidates who have been placed on the list under the government's “discretion”. By analyzing INPO documents, it finds that most of the documents provided by these candidates date March 09st 2022, exactly the same date when the Government sends the list of ten candidates selected to the country.

By analyzing the applications of three candidates who have never competed, INPO finds that two of them lack motivational letters as the important criterion of the assessment applied by the Election Commission, as well as what is most important these three candidates in their résumés and in evidence offered for work experience have no experience in the field of public procurement.

The INPO estimates that the bypasses of candidates who have been competing and by the Election Commission have been highlighted more than selected candidates, as well as the introduction to the list of persons who have not participated in the competition at all is a serious violation of the practice followed so far in the process of recruiting the chairman and members of the Procuratory Organisation board, severely violate the principles of equality, competition and meritocracy, and, as such as the entire process made partial and political subjective.

INPO urged the Government to re-evaluate this list once again and to send in the country meritive persons who have the right experience and who have been subjected to an impartial and independent competitive process. Also, INPO encourages the Government to withdraw from practices in the future so that public positions and functions can be proposed without competition procedures and contrary to competition principles, meritocracy and equality. / P ERISCOPIA
