This SBASK request is being considered fair by law connoisseurs in Kosovo.
In collective contracts signed by the Government of Kosovo and the Education Union, it is said that holding classes during the weekend and official holidays should be paid at least 50 per cent of the wages.
The SBASK chairman, Nundman Jasharaj, in a proposal for Online Economy, citing the collective contract, has said that free replacement can be done with the agreement between the parties.
We're telling you the right thing, the first violation he ever committed is a collective contract, because Article 34. 8 sets out that lost hours on strike are not replaced, but this could change if both sides sit down and make special agreements. Unfortunately, even with the SBASK, AugustI has done nothing with the Parents' Council because they are the biggest reacters against holding Saturdays teaching, but the Association of Kosovo municipalities has had similar remarks. As for the SBASK, we can't change our position, because that's what the contract is about, but we saw that last Saturday there were schools that insisted on working and we were left to respect the will of the education workers, even though we let them know the contract doesn't owe the”, Jasharaj said.
The education chief union considers it binding to pay education workers if they decide to hold lessons during the weekend.
He says that if asked to address the judiciary in this matter, it will be as he expresses confidence that they will win the case.
The labour law and the collective contract determines that the work week is Monday through Friday, and that if it is because of education workers on weekends or holidays, the state is obliged to pay for the weekend as much as 50 percent as normal pay. If the education workers really get back to work on Saturdays and they apply to the SBASK, we're going to get in support and the subjects we send and we're going to protect our colleagues through courts, as we've done for the files and other issues that are guaranteed by the” contract, Jasharaj added.
And lawyer Yll Zakariya said that there is no law of instruction for the teachers if they are not paid in accordance with the contract.
Zekij has said that holding classes during the weekend is compensated by 50 percent over the wages.
The work law envisions work during the holidays and over the weekend for all employees, even in this case for education workers. Any work over the weekend or on the holiday is compensated with extra pay, and this is 50 percent on the base salary so that if you work on weekends or during the official holidays, then you have to compensate for an additional 50 percent of what is envisioned in their wages as a base wage”, Zeka said.
He has expressed confidence that the Government cannot force teachers to replace lost hours during the strike. The only reason he feels is by agreement between the Government and the Union.
The working law also envisions contract and collective contract, in this case education workers have signed a collective contract with the state which envisions the criteria for replacing hours during the strike, and the collective contract which is the law for the parties to see that replacing lost hours during the strike can only be made with agreements between social partners, in this case it is that only if there is agreement between the Government and the Union can be made without paying hours lost during the strike, the Government is required to pay additional hours if it wants to engage in teaching or duty that does not work on Saturday's faceday, the Zex> has said.
While Debra Hoxha from the Organisation for Quality Growth in Education (ORCA), has demanded that there be agreement between the two sides so that lost hours can be maintained. He has said that the only ones who lose in this case are the children.
I think that the compensated hours have only been paid due to the September strike, but I believe the Ministry of Education and SBASK will resolve this case because they have no conviction of the new class schedule, and therefore they have no agreement and they should look at the content of that collective contract, consider it because the only acts suffered by these disputes are”, Hoxha said. /EO/
