The decision will cost millions in previous payments and force the government to rewrite the pension law.
Currently, women whose men die are paid retirement for the rest of their lives, while men receive payments only if they have children under 18, the BBC reports.
The key-man concept “is not enough to justify this, the GEDNJ found.
The decision focused on the case of Max Beeler, a Swiss whose wife died in an accident in the early 1990s.
Then, 41, he left his job to care for their two young children and was supported by a widows' pension, local media reported.
But in 2010, pension payments were cut off after his little child turned 18.
Beeler, who had been on the job for many years of retirement, filed an appeal against the decision.
