In the ruling issued by the administrative court in Vienna, the court has provided some necessary details about the event that occurred that day.
It all happened on June 5, 2020, when the man who farted “Z. AB” had gone out with his friends to a park when a group of policemen approached him during a routine identity check.
And here things got worse.
When he released his gases, the complainer was sitting in the park chair,” is written in the document.
“The complainers' partners had laughed at fart and witness F had made a joke,” continues the document. Because of this, the defendant was grinning in front of the cops. ”
In court, 22-year-old said the fart was not deliberate and that, even if it was intentional, it would still be within the fundamental right to freedom of expression.
Sadly, though, the judge rejected the argument.
The judge had declared that farts do not contain “communicative content”.
However, he had lowered the fine from 500 euros to 100 euros. The defendant's lawyer had said that his client is willing to die for his right to fart and that they would appeal the verdict. /Periscope
