He was sentenced to three years in prison, two of which were suspended, while Judge Christine Mée said he might be allowed to carry out the sentence at home, equipped with electronic bracelet at the event.
That means Sarcozy will spend the 12 months of her sentence at his wife Carla's luxurious Paris villa, 53-year-old former millionaire, models and actresses.
Carla owns her 3m-euro house in the 19th century exclusive building in the French capital.
Inside the three-bedroom apartment, former pop star Bruni, has her registration studio. This apartment was previously inhabited by Les Miserables, Victor Hugo and actor Gérard Depardieu.
Sarkozy will also remain at large during the appeals process, which may last several years.
The last French president to be sentenced to prison was Marshal Philip Pétain, a fellow Nazi in wartime II World.
