Beating his wife and brother to try to stop him, a month's detention for the suspect

Initially, the suspect had physically attacked his wife, saying words like “when we were” and then hit him, writes the news.net.

Then the same man attacked his brother, who tried to stop the fight.

Both victims have claimed in the police that the case has caused anxiety and feelings of uncertainty.

The detention measure is appointed to a (1) defendant for two criminal acts: Attack

Prizren, March 27th, 2021 ♫ The Constitutional Court in Prizren, the General Department of Procedure Judge Fatmir Krasniqi, has approved Prizren's Constitutional Prosecutor's request for the appointment of the detention measure during thirty-30 days, which will be counted from the time of arrest of 25.03.2021 and may last until 2504.2021, to defendants A.Q., due to suspicion that he committed two criminal acts by Article 184 par. Three and Article 184 pars. 1 of the Kosovo Criminal Code.

The court, in case of the detention of defendants A.Q., has estimated that there are legal reasons for the appointment of the detention measure, and from evidence collected until this stage, comes the suspicion that:

The defendant A.Q., with the date of March 25 in the evening, in their common house, systematically exercises physical and psychic violence against the injured his wife, in a way that until she was injured was staying in the house, the defendant under the influence of alcohol, in the condition of total drunkenness with 1,030 alcohol-like drunkenness in blood, initially resorts to the injured with offensive words such as <x0lapper, who was whore” and at one moment, stands up and physically attacks the same as you interfere with his brother, who has caused anxiety and uncertainty.

Likewise, the same date, time, and place deliberately uses force against the injured his brother in such a way that until the defendant was attacking his wife, he injured his brother in order to ward him off from the attack, in which case the defendant physically attacks him by punching him, with which acts in the injury have caused his own uncertainty.

Will these facts be argued, however, in the further stages of criminal procedure.

The procedure judge estimates that conditions for the detention assignment have been met, in view of the defendant's character and personality, which results in his consumption of alcohol, adds to the suspicion that the same could escape and be elusive.

And given the evidence that the defendant is a consumer of alcohol and, according to the statements of the injured, the same has formerly been exercising physical and psychic violence against the injurer by insulting and physically assaulting his wife, argues that the same should be sent to the extent of the detention.

Therefore, given the high statement, the Court has concluded that in concrete cases the same are insufficient for regular and normal development of criminal procedure, given the facts and circumstances mentioned above, the manner and circumstances of carrying out criminal work, the home environment in which criminal acts have been committed, in the court's opinion the appointment of the detention measure at present is necessary and reasonable.

Note: Against that decision, the dissatisfied side has the right to complaint, at the Court of Appeals, complaints against this act did not delay his execution.
