Lawyer Arianan Koci has questioned the legality of the Specialised Chambers in The Hague, which today holds the first public session with an accused.
The guest Koci said that in the first contact with the Special, where he is accredited as a lawyer, he said he will raise the issue of its legitimacy. For this, he referred to deadlines set forth for Special Action Five years from formation.
He says the Specialised Chambers have a Constitutional Court and await its interpretation of the issue.
“Today were procedural actions, you had nothing to stress. It is important that the court clarify whether he has a warrant or not, since there is confusion. The Constitutional Court, which is under the Special Court, must clarify as soon as the constitutional amendment clearly envisions that this court will last five years or less and then this constitutional amendment makes confusing references, or instructs in a law that does not speak at all about the continuation of the mandate. The next law then stipulates that the mandate continues until the European Union comes information that has all been carried out, including the complaints of indictees”, Koci has said.
In the course of this clarification, Koci has said it was also Salih Mustaf's current statement of the lawyer, who said he would challenge special legitimacy.
