The Special Court of Kosovo's Special Chambers continue to keep the first charges hidden, despite the six-month deadline for confirmation or rejection of them passed 24 August, so yesterday.
On February 14th of this year, the request has been made for the appointment of the Special Court Pre-Procedure Judge in Special Chambers and ten days later, the indictment has been handed over to French Judge Nikola Giyew.
According to this, it is as of August 24, so yesterday it has completed the six-month deadline under the regulation to establish the indictment and publish it.
Despite this deadline, however, no charges have been issued.
Angela Greep, spokeswoman for Special Court Specialised Chambers, has told the news, that no charges have yet been published, and until it is published, it remains confidential and is unknown when it will be published.
Until now no indictment has been made public, and until the indictment becomes public it remains confidential, along with procedures related to its review. So, I'm not able to tell you if an indictment was confirmed, I can't even say exactly when that could happen”, Greip said.
Greep has made known about the news.net, that despite the pre-procedure judge's having up to six months to publish the charges, according to her, their non-publishment can be done at the request of the judge of the preliminary procedure because of security and that such is the provision of the regulation.
“Although the presiding procedure judge has up to six months to investigate an indictment, even if an indictment is confirmed, order of procedure and evidence envision a number of scenarios that could result in a confirmed indictment becoming public later than six months after his presentation. For example, Rule 88 predicts that the preliminary Judge may order that he will not reveal the temporary discovery of an act confirmed for security reasons or avoid interruptions of procedures”, Greep explained.
But Greep, despite not giving any date, has said the indictment can be confirmed when the accused first appears in court.
In any case, a confirmed indictment will be made public no later than the initial appearance of the accused before the” Court, Greep stressed about the news.net.
We stress that during yesterday's Kosovo Parliamentary MP Haxhi Shala has been invited by the Special Court to the quality of the suspect and should appear before the tribunal on September 8th.
At the same time today, the former Special Court has been invited by the former fighter of KLA, Esset Ujan, but is unknown in what quality.
