“Supporting Government Powers, Article 20, paragraph 4 points a) Law No. 03 L-051 for Civil Aviation, the incumbent Government of the Republic of Kosovo today has dismissed the Director General of Civil Aviation Authority, Mr. Eset Berisha due to violations of his professional duties. Mr. Berisha has drafted and signed the AAC's internal regulation contrary to the law, degraded the performance-free management staff, held other tasks at once, and endangered the Government of the Republic of Kosovo in sending the arbitration. Mr. Eset Berisha, as AAC General Director, has been in contradiction with the law since the beginning, therefore the Government of the Republic of Kosovo, with full law enforcement and priority public interest, has made the decision to dismiss Mr. Berisha, and Mr. Arian Islami, AAC Director General's Bridge, until receiving recommendation from the Ministry of Infrastructure and Environment for the appointment of the new director, according to the legislation in effect”, the report said.

In this regard, Berisha himself has reacted, who calls his dismissal an illegal decision.

Where, according to him, the only reason for this dismissal is strictly political, related to signing the letter of intent with the Lufthansa airline company, Pristina-Belgrade, at the US Embassy in Berlin.

From the media I realized that yesterday at 2100, the government has held meetings and dismissed me from the position of director general of the Kosovo Civil Aviation Authority.

Among the reasons for the dismissal, which flow from the media, because the decision has not yet been published, is said to have issued domestic regulations contrary to the law, that I have degraded management staff and held other pay positions and that I have jeopardised Kosovo Government with an international arbitration process.

In fact, the only reason for this dismissal, though hidden and unuttered, seems to be political, was to sign the letter of intent with the Lufthansa airline for Pristina-Belgrade at the US Embassy in Berlin, on January 20th of this year.

Now I'm explaining to him:

The internal setting of the date. 09.07.2019 was fully drafted and signed in accordance with Article 41 and 42 of Law No. 06/L-13 for organising and functioning of the State Administration and Independent Agencies. All procedural steps for introducing the regulation of an independent agency that reports to the Kosovo Assembly have been respected.

Systematisation and the ranking of jobs at AAC in accordance with legislation in force for civil service has been applied to the Independent Council for Civil Service 2014 and the Interior Auditor of 2018. In both reports there was a larman of the degrees of civil servants, organisational structure (departments by one official) contrary to legislation in power, and has been recommended AAC has since 2014 taken action to eliminate these irregularities. For these reasons, internal regulation has been released that implements all the requirements of legislation in force by implementing the standards for internal regulation.

No AAC official has been degraded. As a result of the extraction of internal regulations, organizational structures with departments have been created according to the number of employees, implementing the standards of Article 41 of Law No. 06/L-13, but civil servants are still not settled in these positions due to procrastinations by the public administration ministry. There have also been court rulings for four complaints against domestic regulation, because some departments have become divisions because of the small number of employees, but these complaints were rejected by the Court of Appeals and the Constitutional Court in Pristina. The current legislation of the Republic of Kosovo does not recognise department degradation in smaller administrative units such as the division, but the Government of Kosovo seems to recognise this kind of degradation because you linked the functional position with individuals.

As for my other pay positions (edit), during the time I was an adviser to the Ministry of Infrastructure, I held the position of member of the Pristina- Hani-Elez highway project, and chairman of the Interior Audition Committee at the Ministry of Infrastructure, these two positions I exercised even after the appointment of AAC general director. None and neither are at odds with the law on civil aviation nor with the law on preventing conflict of interest.

The appointment in the position of the general director is in accordance with Article 20 of the Civil Aviation Law, both in my case and in the case of the former director general. There has been no conflict of interest, there is also the Anti-Corruption Agency's decision to do so.

As for the arbitrage process, if the Government of Kosovo thinks there should be deviations from the implementation of laws in the Republic of Kosovo, and the sublegal acts in carrying out these laws, due to the interests of parties who threaten arbitration processes if their interests are affected, then such is unacceptable to a society where the law rules.
EU regulations in our country require that after an airport passes the 2-mile threshold. Travelers, there must be at least two operators for each category of land services. There is only one operator at the moment.

All I've asked for is the opening of the land services market at the “Adem Jashari” airport, the private concession has supported its right to collect fixed tariffs and the inability to collect these tariffs from other operators. Until the opening of the land services market, I have limited approval for the concession and supplier of airplanes, which is the only one because of the legal obligation to open the market.

As it turns out, this is the assessment that the Government of Kosovo has been doing to me for my one-year-old work on insinuating the opinion about financial losses from the non-conception of high air space, about the beginning of the air corridors opening process with neighbouring states (Albania, Montenegro) and taking responsibility from local authorities in airspace, which is expected to be completed quickly;
The return of legitimacy to the AAC internal regulation, which was in existence since its establishment in 2009;
The protection of general public interest in relation to the private concession of the airport;
The signing of the letter of intent with German air company Lufthansa, which if it starts to implement, is a de facto agreement and de jure of Kosovo authorities by Serbian authorities.

I'm sorry, but more than that I haven't been able to do for just one year on duty. Apparently, the government in office has other criteria of assessment and other priorities than law enforcement.

I'm glad I'm not part of those priorities!
