The Constitutional Court in Gjakova has approved Gjakova's Constitutional Prosecutor's request, assigning the detention measure to a (1) months of defendants H. R., Ashkali, citizen of the Republic of Kosovo, due to the suspicion given that he committed criminal acts, slight bodily injury, in terms of domestic violence and non-authorisation of weapons.
On April 23, 2020, at his house in Gjakova, he deliberately causes domestic violence by physically mistreating his daughter in such a way that while the defendant was in the influence of alcohol, he starts to scream and insult her with obscene words, ordering her to be injured. Next, he takes his pistol gun, walks into the room, and he hits his daughter's nose with the lower gun. ”
With these actions, the defendant allegedly committed criminal acts “The slight body enforcement” regarding criminal activity “Dhuna in the family “and criminal activity subx5> kept ownership, control or unauthorized possession of weapons”, these works sanctioned with the Penal Code of the Republic of Kosovo (KPRK).
The defendant will be held in custody for a (1) month, which will be counted from April 23, 2020, and will last until May 24, 2020.
Pre-procedure judge in the Rare Crimes Department, Gezim Pozheg, after reviewing the subject paperwork, has considered the legal conditions for appointing the detention measure to the defendants have been met, as the appointment of alternative measures would be insufficient for successful development of criminal procedure.
The sides have the right to appeal to this decision at the Kosovo Court of Appeals.
