Thaci-Kurdish conflict for definition of freedom of movement” The Constitution is still awaiting comments from parties

The Constitutional Court is urgently addressing Kosovo President Hashim Thaci's request, which a few days ago has sought interpretation concerning the decision to limit movement at certain times. However, from this institution still does not have a definite answer. Comments are also received by some of the interests. [...]

Kosovo's Constitutional Court will give the final word regarding the conflict to the prime minister, who has been prompted following the decision of Kosovo Government First Albin Kurti to restrict the movement of citizens at certain times. This as a preventive measure to the spread of the COVID-19 virus.

After failing to declare the state of emergency proposed by the president -- of the government's decision on limiting the movement -- the presidency is heading to the Constitutional for the interpretation of that decision.

“Taking into account the circumstances created, following the Kosovo Government's decision, unconstitutional decision, as president of the country, with respect to all constitutional and legal competencies, I have decided to address the Constitutional Court in demand for interpretation of the issue of the Government's decision of the Republic of Kosovo number 0115, with the date of 23.03.20 with regard to the Constitution of Kosovo, with regard to the restriction and rights and fundamental freedoms that are protected under the constitution”, President Hashim Thaci said, already asking the prime minister for duty when Albti is pending, until the court decides.

Since the government's decision has not been suspended, the institution that will perform the interpretation of legitimacy could provide its version within days.

The Constitutional today has told Gazette Express that they are addressing this demand with urgency and high priority.

This query is currently under consideration. In the media communiqué released on Tuesday, March 24, 2020, the Court has already made it clear that this subject is being handled with urgency and high priority”, stated Veton Dula, director of the Office for Communication and Information at the Constitutional Court.

The Constitutional Court has indicated on Tuesday that they have accepted the request submitted by the president, which has called for the deployment of early measures until the final decision, where it has called for the implementation of the Government's decision to be suspended.

To make urgent and comprehensive reviews of this request, the Constitution has demanded comments on the subject even from some of the parties of interest, such as the prime minister's office, the chief parliament office, all Parliament deputies and the ombudsman.

These comments, in terms of demand in general, must be delivered to the court on the three-day basis.

As the three-day deadline expires tomorrow, the Court has announced that they have accepted some comments, without equivocating what they are referring to as they add that they are waiting for yet more comments.

The court has already accepted some comments from the interest parties in this case in terms of the provisional measure and is currently awaiting further comments, according to the three-day deadline, precisely with the total request”, have stated by the Constitution.

Kosovo's president has proposed announcing the state of emergency in the country, following the spread of corruption in some of Kosovo's municipalities. Such a statement has been supported by all parties except Vetevendosje Movement.

Why did he support the president's idea, Albin Kurti, we left behind last week and dismissed former Interior Minister Agim Veliun from duty.

A few days later, without LDK's votes in the government, the decision has been made to prevent the circulation of citizens and private vehicles from stopping by <x0, during 10:00 F.M. and from 800 p.m. to 600 hours, in addition to medical needs, production, supply and sale of essential goods (food and medicine for people and animals/spause), and for services that are connected with pandemic management (government management and municipal personnel from these sectors: health, state security and administration)

The presidency has declared that no decision can be made to stop the movement without the state of emergency being declared, praising it as an unconstitutional decision.
