Tinka Kurti has reacted to the failure of the CEC for MPs only because of a provision in the Election Law, which says candidates should be replaced within gender.
Kurti writes on Facebook:
I would never have believed that I could win the vote and not take office just because I'm a woman. I wouldn't have believed any work and irony is happening in the Republic. Today, the CEC has certified new deputies replacing those who withdrew for executive mandates. Despite being voted in front of two other men candidates, according to the CEC they become part of the Assembly, and I do not. This is due to some absurd article within the General Election Law that says replacement of MPs should be done within gender. We all know that the law, including this article, is written to increase MP presence in parliament. What happens now? He just punishes her. Exactly fails to raise 30. While the law speaks of the minimum 30% of MPs in parliament and not the preservation of this figure, it is in fact becoming a barrier for more than 30% women in the country to have.
This certainly conflicts with the constitutional spirit and international principles and other laws that have been written and adopted for advancing women's rights, but it is also contrary to the very concept of equality as the goal and the journey.
This is not just a legal problem but a deep political one. If we allow that to happen, we see pure discrimination even in the highest institutions. That's why it's not acceptable and I'm going to ask for justice.
This, of course, has nothing to do with the other (men) candidates of the Movement that are next to me by vote. On the contrary, for them, as with every LV candidate, I have only the highest respect for correct cooperation. This is exclusively about discriminating articles that learn to promote promotional practices and end up excluding them.
Meanwhile, even Vetevendosje member in the CEC, Mr. Sami Kurteshi, has voiced criticism of the article in question of the Law for Choice.
“Article 112 paragraph two contradicts the Constitutional spirit, the spirit of legislation in Kosovo with the demand for gender equality... A male candidate has been removed from the MP's list for reasons to replace, or where he knows what it takes to bring a male candidate in line. With the will expressed is a female, I think it's a serious violation and a request, a complaint with the Constitutional Court would undermine the CEC's” ruling, Kurteshi said. /Periscopi/
