In an ongoing search for the death of a young Brazilian man slaughtered in 2009 in Hohenrain, Lucerne's Cantonal Court has changed the court's decision. Unlike the Criminal Court, this Canton's guilty of killing has declared a Kosovar.
The accused, who is now 33-year-old today, was acquitted by the Cantonal Court for presuming and assault killings. For these criminal acts, Kosovar has been sentenced to 7 years and two months of freedom, writes Sda.ch.
This court, in the quality of the Appeals Court, has seen it arguing that the deadly stab on the Brazilian, 24-year-old rulings, had made Kosovo rather than the citizen of Macedonia, today 37-year-old, who was considered guilty so far.
The Criminal Court had sentenced him in 2017 to 8 years and 3 months in prison for murder, broadcasts albinfo.ch. The court in question had made that decision based on other Brazilian statements that had survived the attack.
Crime had occurred on a night August 2009. A Kosovo, today 28, had wanted to avenge a coup he had earlier received at a party in Hochdorf. So he and his two companions had attacked Brazilians with hammers, sprays, and knives. One of the Brazilians was killed and the three suspects had fled the scene.
The prosecution had initially marked 33-year-old Kosovar as a person who had slaughtered, and for that crime he had sought at least six years in prison for him. The suspect in question, a few days after the crime had fled to Kosovo, so it was only in 2015 that it was possible to investigate.
He, a pharmacy student, had claimed to have fled for fear of blaming the citizen of Macedonia. I was afraid he would take revenge on me. The court's remarks that he had fled to Kosovo only after the arrest of his friend in question had been made, he had responded by saying that “ai has many cousins”.
The accused claims that only by teletext had he learned, two days after the event, that a person had died in Hohenrain. At the same time, asked by the judge for the level of German recognition, he said he did not know this language at all. The next question, he answered by saying that the announcement from the teletext translated by Google.
The protection of Macedonia's citizens has called for its client a partially conditional sentence on three or fewer years -- for criminal acts, participation in the attack.
Even the Kosovo lawyer, who participated in the attack, targeted a sentence of less than two years in prison, the punishment that would save his client from deportation to Kosovo. But the court has pronounced him a three-year sentence and three months in prison.
