Competition for nominating Special Prosecutor's Chief Prosecutor opens in September

The Kosovo Prosecutorial Council has announced today the competition for the appointment of chief Special Prosecutor of the Republic of Kosovo and the competition for the appointment of the chief prosecutor of the Constitutional Prosecutor in Pristina.

This was done after the adoption of the Order for the appointment of the Chief State Prosecutor and Prosecutors of the Republic of Kosovo.

Prosecutorial Council Chairman Bahri Hyseni said both contests would be open 15 days from the day the announcement appears in the state paper, expected in September.

The contest for Kosovo Special Prosecutor's Prosecutor's Chief Prosecutor is announced unanimously. Public announcement will be useful from the day it is publicly announced, meaning not from today's day but when the contest is prepared and when it appears in the official newspaper. And it will be 15 days from that day”, Hyseni said.

As for the Order's appointment of the Chief State Prosecutor and Prosecutor's Prosecutors Prosecutors Prosecutors of the Republic of Kosovo, Hyseni said it has been drawn up to form standards.

“We have accepted all recommendations that have been acceptable, which have increased the advance of the previous regulation we have had, increased transparency, guarantee meritocracy and there are substantial changes”, he said.

Commission for Normative Affairs Chairman Zejrullah Gashi indicated that the prosecution's appointment process would also ensure an independent KPK procedure.

The completion of regulations is being made in full and direct co-operation of the American Embassy, but important roles have been played by other partners at the British Embassy, B. E, UNDP as well as local non-governmental organisations such as IKD and GSPJ. Under this regulation, the prosecutorial appointment process will be based on objective and transparent rules... KPK members will play an active role along the processes, first through the adoption of this regulation in line with standards, and secondly through transparent and impartial process of selecting the best candidates based on their merits”, Gashi said.

At this meeting, Chief State Prosecutor Alexander Lumez said there should be recordings of the conversation with candidates. According to him, there are no criteria for interviewing the candidate, while the recording should not serve the needs of the procedure.

“We have no criteria for interviewing candidates. Disreputant right to interview, no. So this cannot be used in judicial procedure, because it is not being investigated for interview, and the recording does not need to serve the needs of the procedure if we don't have an indictment, because it is not being investigated for the interview process”, Lumez said.

While Bahri Hyseni, among other things, indicated that they have taken two requests for disciplinary measures against the two prosecutors.

In this regard, members of the investigative panel were chosen for the AD.n.17/19 cases, which are Valdet Gashi, Ismet Uniman, Nijazi Rexha.

While the Director of the Prosecutor's Performance Review Unit, Valon Jupa, announced the state of criminal speculation for the first quarter of this year's arms, drugs, organised crime, corruption, money laundering, trafficking of people, economic crimes and inciting hatred. He said there are a total of 3 thousand and 347 cases not prosecuted, at the end of the reporting period.
