Considering they are uneven with other members of Kosovo's negotiating team in dialogue with Serbia, members of civil society have decided not to become part of this team.
Although with the Law for Dialogue adopted in the Kosovo Assembly in December last year, civil society has been reserved for a seat, however, none of the civil society has joined this team.
From the beginning, however, members of civil society have sent their remarks on the Dialogue Law, considered unconstitutional.
According to jetai Krasniqi from the Kosovo Democratic Institute, the Law for the State Delegation lacks the selection part of the civil society member by putting him in a different position with the other members of this team.
“is not clear, there is no transparency or it is not clearly even in the law defined as to how the selection will be made. In fact, the law says it will be nominated by the two delegation leaders, or if there is no agreement between them then it will also be voted on by the rest of the delegation. Despite how one member of civil society is selected in this delegation, in the way it is envisioned there does not mean that it represents the entire civil society of Kosovo”, Krasniqi told Radio Free Europe.
Even the Kryeziu Progress by the Committee for Jury and Political Studies, says the problems of selecting a member of civil society start with the bill. According to him, the way this member's selection is regulated makes it automatically uneven with the other members of the state delegation, and the civil society representative would not have the same burden in the delegation.
While members of the state delegation have been voted in the country have received legitimacy from the Parliament and can be dismissed from the Parliament, the member of civil society can be elected by the state delegation. So, civil society member elected the state delegation, and it can free the same delegation. So, the civil society member in this delegation is not equal to other members”, Kryeziu told Radio Free Europe.
Kryeziu says there is no and has not so far had a will to fulfill this seat.
“Delegation has been formed with the purpose and reason that an entire inclusive body will be created offering social political compatibility, so a member of civil society, at least preambled to be a member of the civil society”, Kryeziu says.
