(7 years ago)Kosovo's Appeals Court has rejected complaints of defence lawyers against the appointment of a month's detention measure against 31 defendants suspected of criminal acts; participation or organisation of the criminal group, taking bribes, forbidden trade, misuse of official authority and other criminal acts, all arrested during the action. The Constitutional Court's rulings in Pristina, dated 30.05.2019 and 01.06.2019, have remained in force.
According to the Special Prosecutor of the Republic of Kosovo, defendants A. V-B, V.D., I.U., are suspected because of criminal acts “The taking or organisation of the organised criminal group”, regarding criminal acts: “due to official duty or authority” and “Taking in Ryshfet”.
The defendant I. J, A.I., F.I., B.U., N. J, J. J, A.J., M.J., N. B, J.M. and S. I, they are being suspected because of criminal acts: “The participation or organisation of the organized criminal group” regarding criminal acts: “The banned trade” and “Avoiding customs mandatory tariff payments”, the Appeals Community says.
Prescription A. M, A.P, A.H, B.N, B.T, B. L, B.M., B.M., D. S, J.D., K. S, M.M, O. K, R. M, R.K, Mr.B. and Mr. S, due to criminal acts: “The participation or organisation of the organized criminal group” related to criminal acts: “due to the use of official duty or authority” and “taking bribes”, it says further.
The Court of Appeals estimates that criteria from Article 187 par.1 below have been met. par.1.2 points 1.2.1, 1.2.2. and 1.2.3 of the Criminal Procedure Code, because there is danger that defendants can escape or flee to avoid criminal responsibility, can influence evidence or witnesses, or can repeat or commit any new criminal act.
