Restruction of Borders Unable by Constitution

So states university professor Mazbul Baraliu, who says that the idea of redressing borders is impossible to achieve, for according to him, there are constitutional barriers that are beyond reach.

He in an interview for KosovoPress says President Hashim Thaci's idea of restructuring borders with the Serbian state, for the Presevo Valley to join Kosovo, is impossible by the Constitution itself.

Professor Baraliu claims that the ideas of correction of borders over the years have produced only disasters, so, according to him, this idea of border correction is imported from eastern circles, from Russia and Serbia.

The idea is that I don't think it should be implemented, I believe it's clear to the international community now, for the international factor even for the local factor that this idea cannot be implemented for reasons even of constitutional problems and consequences. The constitution of the Republic of Kosovo, if such an act were to take place in Parliament -- that is, the negotiations -- that would eventually be connected by anyone to Kosovo's institutional representative -- would have to be approved in the Parliament and the Assembly needed 2/3th of the Parliament. While this Government now does not only have 2/3 of the parliamentary votes, it does not even have what is called the simple majority does not have 61 votes, sometimes there are serious problems in implementing the legislative agenda on the part of the Parliament”, he says.

In addition, Baraliu says that for such an idea to be realised, 2/3 of the votes from communities are needed. According to Baraliu, they cannot count on the votes of deputies from the Serbian List.

“could have other consequences and other obstacles, such as the plurality or the double majority of the bandit, which, apart from the majority of all political subjects that have to vote, would also have to vote on the majority of communities. While the Serb List as a member of the ruling coalition is now that so many months it is outside the Parliament, outside the Government, outside institutions, and it is the opposite of an objective reality to say and institutional integration in Kosovo. But, it is a barrier that is constantly made under the pretext of various requirements that are both Belgrade's demands, that is, being told by Belgrade. This political power, this political force, is instrumental and it would have to be a crucial part of this problem -- the adoption of any agreement and ratification of it eventually in exchange for territory or border correction. So there's a lot of problems, primarily constitutional barrier that is inexorable, and if someone wanted to embrace this idea I think constitutional barriers are such that they wouldn't allow this to be realized”, he says.

For Professor Baraliu, statements that Serbia will give the Presevo Valley without taking anything are illusions. He even says that anyone who recognizes Serbia and the last two centuries knows it seeks territories and does not give up territories.

The idea is illusionistic for Serbia to give eastern Kosovo and take nothing is irreplaceable, even more so when we consider its discours from Tadic to its president to Vuciqi who has said that no one can win anything, as they consider Kosovo, and someone loses everything. Therefore, this theory is the intensificationist theory that talks a lot that Serbia does not give up on territories, but requires territory”, he declares.

Baraliu has also talked about dialogue with the Serbian state, where he has said that to recognise Serbia Kosovo must completely change the current political class in Serbia.

“I am convinced of more that Serbia would classically recognise Kosovo, Serbia should have more leadership, it should have another Constitution in power, it should have another political class, and not a political class that is heir to Milosevic's heritage. So a genocide legacy that has fought several wars and genocides not only in Kosovo, in Bosnia and everywhere. I think Serbia is tactical, Serbia has no vital interest in recognising Kosovo, it will probably normalise an agreement to normalise relations with Kosovo, but not also for classical recognition. Even if it was classical recognition doesn't mean anything, Kosovo doesn't even need classical recognition in the diplomatic sense and classical international relations of Serbia, because Serbia will still continue to work against Kosovo in any Dimensio n”, he says.

But, he says even if recognition should occur, there would not have been stabilisation of relations, as according to him, the Serbian state does not implement the agreements reached.

We remember that the idea of uniting the Presevo Valley with Kosovo has emerged last year by President Hashim Thaci.
