Law institutions are doing little in dealing with physical and sexual violence. As a result, the requirements for detention in cases of violence are also very low. Of the 2959 cases of criminal prosecution in 2016, the prosecution has made only 84 requests for detention in 2017, only 115 cases, as well as the first half of 2018, in 69 cases.
So Ariana Qosaj Mustafa of KIPRED said on the occasion of presenting a joint report with GLPS and Artpolis, ahead of the Commission for Legislation, Mandata, Imunite, the Assembly Order and the supervision of the Anti-Corruption Agency, where it was discussed for the protection and promotion of human rights in Kosovo through active civil society.
She said there is a lack of seriousness on the part of justice institutions to deal with cases of physical and sexual violence, as, according to her, in cases of sexual harassment, cases of rape, but even those of LGBTI, there are no standard procedures of action in the justice system.
The report, as she said, has recorded no seriousness of justice institutions to address cases of physical and sexual violence.
It has shown what happens to cases of violence at the moment of its reporting, where police made a risk assessment but no further, which, according to her, indicates that the risk assessment is not done fairly. According to her, there is an extremely small number of reports of sexual violence.
While he said they have noted there are several prosecutors who, despite the withdrawal of the victims, continue prosecution.
“has been noted that police, judges and prosecutors still need to follow specialised training, because the connection between gender nature and acts of violence is not understood yet... 4:33 The requirements for detention in cases of violence are very low. In 2959 cases we have had in 2016, the prosecution has made only 84 requests for detention. It means we only have 2.8 percent of the cases. In 2017, it was sought in only 115 cases -- 11.3% -- as well as the first half of 2018 -- that detention was required in just 69 cases, d.m. th 5.5 percent... In 2017, we have pictures that say that half of the criminal allegations regarding domestic violence were rejected, meaning 51 percent of cases rejected by the prosecution. This shows that there is no seriousness in the institutions of justice when reporting declined the cases of violence”, she said.
Mayor Albulen Haxhiu said a co-ordination of the Parliament and civil society is needed to solve the problems addressed today. He also spoke of the Istanbul Convention.
“It takes a co-ordination, co-operation, even the country's institutions and civil society to address these problems... 11:19 We should have prosecutors, judges and specialised officers who handle these cases, and are not burdened with patriarchal mentality... 12:04 The Istanbul Convention is the day-to-day point, the commission has given support to the Albanian deputies 2/3 and 2/3, or 14. Therefore, I don't know if we will manage to secure the votes of other communities”, she said.
The MP from the Initiative's ranks, Bilal Sheriff, said it is not becoming enough even in education, where, according to him, violence should stop there first.
Unfortunately, we're not doing enough in the education system either, because domestic violence is stopped at the time of our childhood. Are we doing enough, I'm not yours without”, he said.
And Vetevendosje MP Sami Kurteshi said the law on domestic violence is absurd.
According to him, in Kosovo police there is no protocol of meetings of police officials with citizens. For this, he requested that the registration and protocol be made of each meeting.
And what does it look like? You take out your wife and children, whether in shelter, the bully stays at home, comfortable, comfortable. This is a double crime, the second is much more expensive for the state, it's better to get a man out of the house, leave him a 5 at home where they're comfortable living. But we can't do it like we're friends. 95% of property is in the name of men”, he said.
While PDK deputy Hajdar Beqa said the responsible institutions should make the right decision. He said that there are times when the victim is the man.
As for the Istanbul Convention, Beqa said it costs it. According to him, it may be her voting problem at the session because of the Serbian List, as its vote takes 2/3 of the votes.
Otherwise, the Istanbul Convention will be reviewed Friday at the Kosovo Assembly session.
