PSD-VVAė after criticism of the Dialogue Law: Learn to Respect Court Decisions

At the longest session ever held in the Kosovo Assembly, during yesterday's day it was voted by 61 first reading of the Bill on Duties, responsibilities and competencies of the state delegation of the Republic of Kosovo in the process of dialogue with the Republic of Serbia.

In the debate, which has been held in recent hours, Albulen Haxhiu from Vetevendosje has had many remarks on this bill, where, among other things, he has warned that he will be sent to the Constitutional Court.

The “those who have taken the votes of the Vetevendosje electorate have no right to enter the markets and have no right to legitimise Thaci. If they want to let him go, let's go to the elections, and then we can see who he is. So, no one has the right to make other decisions as long as the deputy with Vetevendosje voters' votes. This law is scandalous in political terms, but also against the Constitution. On behalf of the parliamentary group, I announce that we will send him to the Constitutional Court. Now someone says, come on, say the PSD has also captured the Constitutional Court, no. Amma, PDK is working very well for The PSD, because that's how Thaci and PDK are adapting to”, Haxhiu said.

Haxhiu, among other things, said this bill was written by Hashim Thaci himself. He does not set up any red line for which he will discuss it.

Constitutional Law Professor Mazlum Baraliu says the Bill for Dialogue has been unnecessary, given that Kosovo has the Law for International Agreement.

It is a law Kosovo has for international agreements. And for whatever agreement you want, at any level, in any case, that law which is in force, and has all the mechanisms of a law, appropriate to respond to the requirements of international relations, diplomatic relations and the connection of conventions and agreements to which state in the world wants. Whether bilaterally or more, it is in force, and it would be much better replaced by this legal act that is trying to handle, position with an opposition party like lex specialis, to carry out the work in any contact with whom the international community is subject to”, Baraliu said.

This bill, he said, was necessary to challenge the inability and inability that was evident to the ruling coalition to make a joint consensus team, position-opposital.

That this bill has been unnecessary, says political analyst Ramush Tahiri, thus said he would be integrated in the work of the Parliament.

This area is not regulated by law, meaning dialogue, because we have no law on international relations, it is regulated by the Law on the ratification of international agreements, regulated by the Law on the functioning of the Assembly, Government, Constitution and other laws. And MPs in my opinion, rightly, said they could not be regulated and additional competencies given to other MPs, as well as to the way of decision-making in the Assembly, except what is meant by the constitution. They also stressed that someone who is an MP does not have the right to be executive, which is the certain rate. And whether the documents will be secret or not, there are laws that define them, and that cannot be described as ad-hoc commission. Also proclaiming the law as a special law is considered to be outside the constitution, because this law consists of full Kosovo laws, but also the work of the” Assembly itself, Tahiri has said of the KP.

In a written response, the media official at the Social Democratic Party, Shkodran Hoti, said this Vetevendosje warning is legitimate. But that, according to him, the VV should begin to respect court decisions.

The right to address the Constitutional Court according to legal norms is the guaranteed right in the Republic of Kosovo. This certainly applies to Vetevendosje, which will probably in the future begin to respect the court decisions, where procedures were set up, as in the case of the Parliament's deputy head of the Parliament”, Hoti told Kosovas.

But, according to Mazumum Baraliu, if this bill is to be passed on to second reading, and sent to Constitutional, then the procedure should be stopped until it is treated, and as such it should not go into effect. We remember that five conditions had set up the Social Democrat Party when, as an opposition party, on December 21st last year enabled the 2019 Bill on the Budget to be passed in principle. All these conditions have been met during yesterday, including the dismissal of former minister Nenad Ricalo.
