Three executional pages for the three killed in the neighborhood “Matt 1”

Among the three dead, one was from the Mehmet family, one of the Rafuna family, until this armed conflict had even passed away.

85 days later, in terms of this case, the Constitutional Prosecutor in Pristina has filed a three-page indictment at the Pristina Foundation Court, reports “Justice Vow”.

In this case, for attempted murder and illegal possession, Naim Mehmeti is charged.

“There is doubt that following a property dispute between the Rafuna and Mehmeti family, on September 5, 2019, around 15:40, at the crossroads of the “Muharrem Feyza” and “Jakov Xoxa”, defendant Naim Mehmeti has attempted to deprive the late Mufail Rafu <5x> of life in this act.

One of the three pages of this charge is said to have done so in the way that the defendant has previously argued with the deceased man around the side of the stairs, which had ironed Mufail Rafuna, and the moment the late man has now pulled his weapon out of the bag, the defendant has started running around the premises.

According to the prosecution, the late Rafuna shot the defendant with a gun and hit him on the left leg loop and the thumb of that leg.

On the other hand, the defendant reportedly went to the apartment located on the third floor, heard gunfire, took automatic weapons, went to the entrance of the apartment, saw the wounded Mufail Rafuna, and his brother, the Mehmet Union, but fortunately now the Kosovo Police member involved in civilian clothing, Irfan Bulnjak, who has managed to take the gun “AK 47”, by the hand and to take control of the defendant, in which he had the bullet in the barrel, and 28 more bullets in the clip, while the policeman noticed he was injured by the Mufail Rafuna shooting.

A little over a page of reasoning on this charge is discussed by the testimony of the one witness proposed in the indictment and just two material evidence. Also listed in this part is the defendant's statement.

As far as the attempted murder remains, the prosecution body has issued nothing on the form and manner of carrying out this criminal act, namely the actions taken by the defendant, by which he has attempted to deprive Mufail Rafuna of life.

Among other things, in the device of the indictment, the victim, the indictment is repeatedly referred to as the late “, by the device in this indictment under any circumstances, as to murder or attempted murder.

Article 20 of the Republic of Kosovo Penal Code (KPRK) stipulates that “the person has not been prosecuted responsible when between his action or inaction and the consequences lack the cause connection”.

In the sense of Article 241, paragraph 1.4 of the Penal Procedure Code of the Republic of Kosovo (KPPRK), the prosecution in this case does not at all clarify whether Mufail Rafuna, referred to as the late “man, was killed as a result of the defendant or any third person involved in this conflict.

The prosecution, on the other hand, refers to a criminal offense with a no-designment in the Code, under which the prosecution has filed this indictment. The legal appointment of KPRK's Article 172 is “the murder”, until this criminal act, the prosecutor refers to it as “attempted murder”, which does not exist in the KPRK.

The case of the legal appointment of criminal acts in the indictment is determined by Article 241, paragraph 1.5 of the KPPRK, where it says the indictment contains <x0 legal appointment of the criminal act by referring to the provisions of the Penal Code”.

On the other hand, the indictment device 2 charges the defendant for criminal work “ownership, unauthorized control or possession of weapons”, has not been proposed by the seizure of weapons and already seized bullets.

Due to major qualms, the “Justice Trust” has contacted prosecutor Ilaz Beqiri, who has compiled this indictment.

He has said that the reason other people felt no mention in this case is because it is not possible for the dead to conduct investigations already.

Meanwhile, it has revealed that Mufail Rafuna has been killed on the other side of the deceased, Bashkim Bashki.
