Through a communiqué to the media, it is known that the Secretariat has found that certain aspects of the contract as purchase for 20 years of energy availability under the energy purchase agreement, transfer of ownership, state guarantees, exemption from VAT, and other benefits represent state assistance sanctioned by law.
These findings were also visualized in the infographics for State Assistance from organizations: B GF, GAP, GLPS and INDEP within the campaign #mousecampi.
Higher organisations have consistently argued that this contract, in addition to devastating financial and environmental damage, will damage Kosovo's integration path as it undermines market liberalisation and competition and favours beyond logic a private investor against others and against public interest.
Otherwise, since October 2015, Kosovo is a signatory party to the Stabilisation and Association Agreement. Article 77ec of this agreement, similar to EU laws, prohibits the commitment of state support for subjects if it can affect competition. Failure to abide by this agreement could disrupt negotiations on EU accession.
“Balkan Green Foundation (BGF), GAP Institute, Group for Jury and Political Studies (GLPS) and the Institute for Development Policy (INDEP) urge the incoming Government to consider all these facts and withdraw from this harmful contract. This would pave the way for energy market development by promoting real investment, as well as protecting the European environment and future of the entire sector”, the communique said.
