Anti-Serbian Minister Nenad Ricalo's Anti-Species Raises

Kosovo's Special Prosecutor has filed an indictment at the Special Department at the Constitutional Court in Pristina against eight N.R. defendants, K.H., United States, E.J., S.M., L.T., L.K. and A.Z., for misusing the position or official authority, according to KPRK.

N.R., K.H., U.S., and E.J., in interaction during 2018, in order to try to illegally benefit some companies, have acted illegally, and deliberately have acted contrary to Law 04/ L-090 for changing and completing the 03/03 Law L-098 for agriculture and rural development, Article 5.1, Article 8, Article 13, paragraph 1.2, Article 4, Article 14.2, Law of 03 L-098 for agriculture and rural development, Article 8 and 9, regulators (QRK) no. 37/2013, Article 7.1, paragraph 1.1, Guide and Doracak for drafting the concept of documents from the Prime Minister's Office.

The defendant Nenad Rikalo in the quality of Agriculture, Forestry and Rural Development (MBPZHR) has exceeded its competencies, drawing up a “special programme”, without a separate budget for this project, has set the criteria, setting the regions for financing, sum of the grant, while bypassing the regular procedures for drafting the particular programme, which was the competence of the Rural Development Policy Department in the MBPHR, overplacing in the midst of regular measures. Also, in 26.03.2018 has illegally issued the decision to draft new development policies of rural infrastructure and to establish competition in less developed rural areas, with the curriculum being also turned over itself, completed, while the commission was formed only formally.

While, defendant K.H. in the quality of the secretary-general in the Ministry of Agriculture, Forestry and Rural Development, has surpassed his competencies, illegally proving that this group is not competent and has no knowledge of the implementation of this programme until it was aware that this group was only formal, knowing that the draft was handed over by the minister of NR himself.

The U.Z. defendant in the quality of the official person at the Ministry of Agriculture, Forestry, and Rural Development during 2018, acting illegally, has drafted and approved the No Administration Guide. 09-2018 for implementing the special program “rural areas less developed”, even though it had known that this program was drafted contrary to Law 04/L-090, for changing and fulfilling the Law of 03L-098, for Agriculture and Rural Development and Rule (QRK) no. 37/2013, bypassing regular procedures to draft the particular programme, which is the competence of the MBPHR Department of Rural Development Policy.

While, the defendant E.J., in the quality of the official person AZHB Chief of Task, has illegally made the decision to form the working group, which would do administrative control, assessment, approval and contract rural infrastructure mass projects in its composition: L.C., St. M, A.Z. and L. Thuk, bypassing the fact that this team should be formed by the director, monitored by the director, and reported to the Director of the Directorate for Project approval and Rural Development. So, the defendant E.J., has deliberately acted in such a way that it would benefit different companies, illegally, because it was part of the group itself when the minister had handed over the willing draft, thus acting, the budget of the Republic of Kosovo in co-operation has caused damage of 4,000,000 euros.

With these actions, defendant N. R, KH, the United States, and E.J., in interactions have carried out the criminal work “The use of official position or authority”, by Article 422 paragraph 1 related to KPRK Article 31.

Also, Special Prosecutorship reports that the defendants, St. M, L.Th, L.K. and A.Z., at 14.08.2018, interacting in the quality of official persons near the MBPHR, acting illegally, in order to enable illegally-advised returns to several companies that have not met the legal conditions set out with the 09-2018 Administrastration Guide, to implement the particular <x0Z> rural areas less developed” in co-operation, in misuse of criminal duty or official authority.
