After Periscop reporting, the CEC explains the provision that enabled Krasniqi to become MP

The Central Election Commission (KQZ) has reacted after Periscop's article showing that the Egyptian Liberal Party of Kosovo had won double the vote compared to the IRDK, the other party of the Egyptian community. In addition, three PLEK deputies had been more voted than Elbert Krasniqi's The IRDK, who managed to become an MP.

Veton Berisha became MP with over 3 thousand votes, while Artan Berisha and Berisha Krasniqi, even though more votes than Mr. Elbert Krasniqi failed.

But why did this happen?

The Central Election Commission has clarified that the Law for Elections, more precisely Article 1.1, requires that the total number of valid votes of political subjects be divided according to numbers of 1.3.5.7.9 and so on.

This is the complete CEC explanation:

  1. The structure of the Republic of Kosovo is clearly defined with the Constitution of the Republic of Kosovo at Article 64. Connecting to the specific issue set forth in the media -- that is, to the division of the seats of the guaranteed countries for the Roma community, Ashkali and Egypt -- the Constitution of the Republic of Kosovo defines the following:

“The Roma community a country; the Ashkali community a country; the Egyptian community a country; and an additional place will be given to the Roma community, Ashkali or Egyptian, which has the largest number of total votes”.

  1. In the 6 October elections, the Central Election Commission has certified 25 political subjects, of them 2 Roma; 2 Egyptian and 2 Ashkali.
  2. According to the final result, among those 3 communities, mostly votes have subjects from the Egyptian community, and therefore they have second mandate, as the communities' votes are like the following: the Egyptian community 6,635 votes; the Ashkali municipality 5,059 votes; and the Roma community, 1,366 votes.
  3. Meanwhile, the law on general elections, Article 111, which explains the division of countries stemming from the provisions of the Constitution of the Republic of Kosovo. This article, paragraph 2, point B and C, explains the division formula for countries:
  4. b) The total number of valid votes won by each political subject in the election for the Parliament is divided by 1, 3, 5, 9, 11, 13, 15, and so on until the number of components exploited responds to the full number of countries;
  5. c) Cofficients resulting from the string of pieces are arranged in the downing order. The countries share political subjects according to the coeffinators so that the first country belongs to the subject that has the highest cofficient, the second-place subject that has the highest cofficiency, and so on until all countries are separated;
  6. The next table shows the result within the Egyptian community:

According to results announced on November 7th, 2019, the political subject the New Democratic Initiative of Kosovo is mandated, as according to point C, it has the highest current cofficient. So 1,754 is higher than 1,627.
