Albin Kurti, chairman of Vetevendosje, before and after victory in the 6 October elections, has declared that besides the PDK in opposition, he also wants to take the Serbian List.
This party has again emerged the main subject in the Serbian community, and according to the recognitions of the Constitution cannot be taken out even in the government's creation.
The Serbian list so far has received 52613 votes, or 6.64 per cent, after counting 99.25 per cent of the vote.
Former head of the Constitutional Court, Enver Hasani, has said Kurti cannot decide on the fate of Kosovo Serbs, of its citizens of the minority community. According to him, the Kosovo Constitution is clear in this respect and envisions two situations.
The first “is the situation when Serbian ministers are nominated by the composition of the Parliament's deputies, and in this case, consultation with the Serbian List is required as the winner of the election. The second situation is when the ministers proposed are outside the Parliament's composition, and in this case the formal decision of the Serbian List” is required, Hasani has stressed for the Koha Ditore. “Sic is seen, in the Constitution there is no possibility that the majority will decide on the fate of the minority. This is the fundamental quality of Kosovo constitutional democracy called the consonantative Democratic Democracy and is sanctioned by Article 96 points 5 of the Constitution”.
The article to which Hasani refers says: “If candidates are appointed outside Kosovo's Parliamentary deputies, for these ministers and deputy ministers are required formal approval of the majority of the Parliament's deputies, who belong to parties, coalitions, civic initiatives and independent candidates, who have been declared to represent the community in question”.
But in past governments it has happened that the ministers of the Serbian List will be dismissed and the appointment of others without formal approval of this subject. According to Hasani, the dismissal does not require formal approval of communities and that this is a political process measured by the political criteria of the balance of political forces.
“Welcome back the appointment of the new minister from the Kosovo Serb line should get from the Serbian List and cannot name anyone else on behalf of the Serb community who does not have the approval of those Serbian parties or collections that have won their votes over five percent of the Serbian vote”, he said.
The preliminary results win the Serbian List, among Serbian parties, while still being the country's fourth political force. This subject has marked increases compared to past elections held in 2017. Until that year the subject supported by official Belgrade had won about 35 thousand votes, it has now received over 52 thousand votes.
Meanwhile, Slobodan Petrovic's SLS has won a thousand and 910 votes, the Party of Kosovo Serbs led by Alexander Jablanovic, has won 789 votes, while Nenad Rassic of the Coalition “Lyria” has won 719 votes.
