The ombudsman has accepted two complaints concerning the election process, claiming there have been violations of the right to vote. One complaint is grouping and concerns diaspora votes that the Central Election Commission has not declared valid, while the other is an individual complaint. Ombudsman Hilmi Jashar says the institution he heads will review the accepted complaints and stand out.

On the day of 6 October, when early elections were under way for the Republic of Kosovo's Parliament, the institution of the Ombudsman has kept the central office and all regional offices in the country open, aimed at accepting possible complaints with allegations of voting violations or abuse of guaranteed rights with the Constitution and laws in force.

In an interview for Kosova Prees, Hilmi Jashari says that on election day they have not accepted any complaints, except after that day, the non-governmental organisation “Germin” has addressed this institution with complaints concerning diaspora votes, which are considered invalid, since they have arrived late.

“Two complaints -- one is the group that deals with the vote of persons living outside Kosovo -- voting that has been made outside Kosovo and is considered fair by the 5 October, while they have arrived late in the CEC post -- which is that at the claim of a legal argument does not consider them valid, and therefore does not introduce them in the counting process, and this is the complaint that has been filed and we will look at in the coming days to see which will be the stand of the Ombudsman<1>, he says.

The next complaint, as the head of the ombudsman's institution shows, is individual, which has reached electronically and the individual claims there has been violations of the right to vote.

Yasar says they are in the phase of the review, and in the coming days, they will take a stand over the earlier complaint.

Meanwhile, for that of the organisation “Germin”, it says it was initially addressed to the Central Election Commission as well, and the decision is expected following review by the Electoral Panel for Anxiety and Parashtre.

Yasar also answers about the indictment has been filed in court for the Central Election Commission, respectively, on this institution's decision to prioritise electoral lists by political parties, which, according to the ombudsman, is contrary to the law on gender equality, 50-50 quota.

As Jashar claims, the case is under way and no final decision has been made.

“This has been forwarded with a temporary measure to the court as a indictment, is also required to suspend the process until the Court finds out whether there has been violations of that right or not. The provisional mass has been issued by the Constitutional Court and this demand of the ombudsman has been rejected as a temporary measure, while the rest of the indictment is still under way and has not yet been finally established”, he says.

Kosovo has held extraordinary parliamentary elections on 6 October, meanwhile, the final results from the CEC have not yet been certified since the recounting, which is becoming the result of ballot irregularities, has not yet been completed.
