Numerous processes of marriage solutions mainly highlight the daily problem of reference to the vital minimum, which does not coincide with meeting the basic needs of children. In 2017 the divorce rate again increased, reaching 19.9 divorces in 100 marriages, according to the latest INSTAT report.
Legal experts have reported an increase in trials even this year, related to the problem of food pension, which in case of divorces, the father has the legal obligation to pay child/children.
The food pension mass, (7000 lek per month), results in discrimination in each case and does not in any case represent the child's highest interest. The lack of reference to such an act has directly affected thousands of children over the next few years to again touch others day after day, thus violating an acceptable standard. A specific approach to this problem, the primary obligation of line institutions, a literal study of field specialists, to the creation of a standard which presupposes the physical, psychological, and social needs of each child, compatible with the proper dignity of each individual, referred to international standards set for that purpose. ”-poon av. Denise Daka, adding that at the court's doors, among family matters, there is an increase in food pension indictments.“The missing VKM in terms of the vital minimum for children penalises many families day after day. The lawyer's”-rejects, naming both extremely important and the necessity of a special voice approved in the state budget for this cause.
According to the Tirana Court, the food pension indictments this year -- from January to October 20th -- are in total 22, among which only 12 cases have been concluded and 8 complaints. According to experts, this is true in cases where a spouse is involved in the divorce process, denies the payment of a month owed to the child, or is appointed by the court itself to the anticipated minimum payment.
Psychologists near the Court of Tirana have previously declared “Monitor” that two out of four divorced mothers do not receive full child support payment. Others are forced to abandon the work they had previously had in terms of looking for suitable work even with child time (economically, the presence of a babysitter or a private garden/school). During the process of job research, they often face prejudice or difficulties. /Monitor
