In the Kosovo Police, 375 employees of police staff continue to exercise jobs incompatible with the winning degrees and that with the general director's decision, compensation for employees exercising higher positions, is done on the basis of position, not on the basis of the degree the employee has achieved.
So says the report for 2017 of the National Audition Office, which includes the Ministry of Internal Affairs and the agencies she has undermanagement.
According to the audience, paying on the basis of position is contrary to the PK's salary system, where the central wage co-efficiator for police staff is determined depending on the rank rather than the position of work.
Realisation of the budget for capital investments, according to the audience, remains the main challenge facing MPB and KP. Even though the annual spending in relation to the final budget was 98%, the audience says it cannot be said to be an indication of good performance if compared to the original spending budget was only 50%.
“According to the initial budget law, 52 capital projects had been planned, while only 37 projects had cost taken place. The reasons for not implementing projects include the lack of requirements for initiative of procedures, delays in the initiative of procurement procedures in relation to the plan, annulments of procurement processes, and delays in signing contracts as a result of complaints and contests in OSH”, says the report, underscoring that MPB, including the pending management agencies, had not planned/prespecting the value of the revenues that will accumulate during the 1920s and, as a result, PFV, compared to the practice plan has been impossible, KPs.
“on MPB and the subordinate agencies continue to hold quality leadership positions of the Task Guide in long-term, failing to meet with regular work positions. Article 30.4 The Law for Civil Service of the Republic of Kosovo stipulates that for the fulfilment of the civil service free position, the task leader cannot be named longer than three months. And the UA No. 07/2012 on the job relationship at the PK determines the time period for the U.D. for up to six months with the possibility of another three months. According to data reported by the Staff Units for 2017, the number of positions held with the UD was as follows: In MPB 10 positions, of which a position from 2014, four positions between 2015 and two from 2016; At ARC 11 positions, of which two since 2011, two from 2015 and one from 2016; At the Koso Forenzica Agency (AFK) a position from 2016; In the Agency for Emergency Management (AME) six positions, of which four by 2011 and two by 2014; In PK 15 positions, of which, a position from 2014 and three positions from 2016; At the Kosovar Agency for Public Security (AKSP) two positions, one since 2013 and the other since 2016; and the Kosovo Police Inspectorate (IPK) a position since 2016. In order to regulate the work relationship at KP, it was applied during 2017 UA No. 07/2012 and 03-2017, which were later abolished with the entry into force of the UA No. 04/2017 in December 2017. This guide, as well as the preliminary guides, envisions that in the case of setting employees or setting up jobs in free positions, conditions and criteria for those positions, including qualifications, degrees, experiences, etc. At the KK, 375 police staff employees continue to exercise jobs in disagreement with the degrees won. Under the General Director's decision, compensation for employees exercising higher positions is made on the basis of position and not on the basis of the degree the employee has actually achieved. This phenomenon is contrary to the PC's wage system, where the basic wage cofficiti for police staff is determined depending on the degree rather than the position of work. In this regard, we have recommended in the early years. Despite this during 2017, there was an increase in such cases”, the report says.
The MPB, according to the audience, continues to engage employees with arrangements for special services that are engaged without regular recruiting procedures. The number of engage in this form during 2017 was 13, of which nine cases belonged to AME. In nine of the 13 cases mentioned above, the legal duration for commitment in this form was exceeded.
The audience also says that the financial regulation stipulates that “all bills that accept budgetary organisations must be paid within 30 days if it is not provided otherwise by contract, and on six fees tested at a common value of 303,353euro, there has been a five to 78 day delay, following a 30-day term for a fee”.
During 2017 the reintegration budget was subsidised by 311 beneficiaries. In the period April-August 152 beneficiaries, and in the September-December period, payment was made for 159 beneficiaries.
“We have analysed the MPB report and the mirror of financed projects for subsidies beneficiaries for the April-August period. For this period the beneficiaries have been obliged to offer evidence that the vehicles obtained by the MPB have spent them in line with business intent. Based on monitoring conducted by the MPB team in the field, we have noted that for this period, 94 businesses were active or 62%, while 58 or 38% were inactive businesses. During the audit, we also found that in paying for the 3,000-dollar business plan, the beneficiary had offered no receipt that proves the means were spent in line with the business plan. According to “The operational public procurement guide”, Article 35 of this instruction, respectively: The procedure for testing, assessment and comparison of tenders will be carried out by the Accounting Authority within the shortest possible period of time, and no more than 30 days from the opening of bids. Only in extraordinary and justified cases, in particular with contracts of a complex nature, this period can be extended for an additional ten - day term. We've found that in the procurement process for “The production of anti-plumb vest”, there was delays in the outcome of the assessment, over three months (the assessment of the bids started at 14,11,2016, and it ended with 21.03.2017). According to testimony provided by police, this delay has occurred in the inability to implement an O verdict. The EPS, for reasons that were not dependent on the Accounting Authority. The decision involved testing high-key equipment”, the report said.
The initial contract for the construction of the Municipal Centre for Civil Regiment (QKRC) and the Municipal Centre for Automake Recording (QKRA) in Istog, according to the audience, signed in 11.09.2015 of the value of 309,155, parameters for the building of the object to end with 115 working days and as a consequence of ill planning, following the start of construction jobs were noted in the basic project, and with the case Contractation Authority (AK) on the 14x2016, there was a contract on 6,36x for the elimination of these shortcomings.
In addition, in December 2016, a contract for additional jobs of 6,660 was introduced. The technical acceptance of the facility was made with 14.12.2017, or about 18 months of delay from what was envisioned in the initial contract. At the AKSP, the bidding assessment commission for procurement activity “The renovation of the AKSP” facilities has begun the bidding assessment process seven days after the opening of bids. This is contrary to the operational public procurement guide, Article 41.2, stating that the evaluation process should begin more recently than five days from the opening of bids. Furthermore, in the “construction and constructive material framework” contract at the AKSP, the signing of the declaration under oath by the bidding assessment commission was made four days after the launch of the tender assessment process. In the 27 tested payments involving MPB, PK and AKSP (20 on goods and services and 7 with capital investments) we found that the ordinance was issued after accepting the goods/service, and after accepting the bill, while in 20 cases the commitment of the means was made after accepting the bill. This is contrary to general procedures for processing payments defined by legislation in force. In connection with the above-mentioned cases, in the MPB, under the contract “Inform media outlets” worth 17,818% was also preceded by the implementation of the television anti-terrorism spot, as well as the purchase of advertising space for the display of this spot on television and online portal at the value of 9,794. The contract provided that the service be carried out within 45 calendar days from the date of taking orders and publishing should be completed by 31,12,2016. This service was delayed, and the publication was made in April 2017. The transaction was issued after the receipt was received. In paying “Certificates for car registration” worth $27,700m in MPB, there was a delay in accepting homesicks for 56 days. The contract manager had extended the delivery time for 30 days, with the argument that the supplier had avar in the warehouse. But under the specific terms of the supply contract, I can ask for a extension of the license deadline only if the implementation of the contract is delayed due to causes that are not wrong with the supplier. The adventure at the warehouse was caused by the supplier's error because the warehouse failed to meet the conditions for the preservation of goods. Despite This Fact The MPB had not implemented the/penalatine ban for the delay of 900 euros”, the report said.
In paying “
The contract had expired with 12.11.2017, the bill was accepted by 20.12.2017 while the transaction was issued by 21.12.2017. Kosovo police have purchased information technology equipment worth $7.928, but out of that amount, articles worth $2.830 were not registered in the property registers. An article from this purchase belongs to the capital property category worth $1,220, while two articles of wealth under 1,000m worth $1.610. Likewise, MPB had not registered as assets below 1,000m five climates, worth $1.044, which were purchased for the AME's needs. Furthermore, the ministry under capital projects had implemented the contract for the creation of unified “System for statistical reporting”, whose value was 41,595. This system was not registered in the register of assets over 1,000m as capital assets, but was divided on the basis of articles where a stake of 10,679m was registered as assets below 1,000m, items worth 2,594m were registered as capital assets, while the service of 24,000 had not been registered at all. Management the fleet of KPU vehicles, which includes auto repair and repair, continues to be weak. The delay in auto repair was prolonged, with a number of vehicles waiting for service from 2016. The reasons for such long waits for repair vehicles, according to navy officials, were various types of vehicles and defects of various natures (which require adequate knowledge), small number of personnel, lack of spare parts, and age of vehicles. The number of vehicles waiting for repair included 32 vehicles between 2016 and 77 vehicles in 2017. In this matter we have recommended even past years but no measures have been taken to improve the situation.
Two bills worth a total of 30,341 euros. PK), for fuel supplies, had not been reported as unpaid obligations and had not been unveiled at PFV in 2017, even though they were accepted in June and August 2017.
