At the Constitutional Court of Mitrovica, sessions have failed to be held in the case where the indictee is Hysamedin Peci.
Hysamedin was indicted by his sister, Shyhrete Peci, about the property she, according to the indictment, had inherited from her father.
Based on this indictment, Shyhrete Peci had lived on the first floor of the house on this property, along with her son, sister, and father for whom he had cared until his death.
She had inherited the floor of the house from her father in this house, and her brother, Hysamedini, and his close family lived on the ground.
After Father's death, Hysamedin Peci in 2008 had filed a lawsuit at the Court for property testimony in the cadastral event in the country called “Nemanjina“, with land culture on the surface of 0.06.60 ha, in the cadastral zone of North Mitrovica.
And Shyhrete Peci after understanding of this request of the brother immediately in the qualities of co-trials had filed the request for proof of property rights in a portion of the cadastral drive because it was her shared property, her and her brother, after the death of father Bajram Peci.
According to the indictment, this property was held in possession and exploitation by no one (as his successor).
While following the application's approval, indictee Hysamedin Peci owes the indictment's decision to recognise property rights at half-two of the cadastral wheel on the surface of 0.06.60 ha, at the place called “Nemanjina” and to acknowledge the right to property at home, as well as to hand over these inconsistequentity in possession and free exploitation, quiet and unhibited.
Because the representative of the indicted party Safet Voca was not present, the session was not held.
Justice Faton Ademi announced at the hearing the unknown party, Hysamedin Peci, that the session would not be held because the representative had announced there was a death case and could not present at the session.
