The Kosovo Assembly session has started with the concern of LDK deputies over the reaction of road vehicles, where they were asked by the Ministry of Infrastructure and the government not to create monopoly.
Democratic League of Kosovo MP Hykmete Bajrami has raised the issue of administrative instruction for determining the conditions and criteria for road counterparts of the Ministry of Infrastructure signed on 12 April this year.
She said that when there is less than a year's end of the contract with the company “Europalyb” -- Devolls and the Ministry of Infrastructure -- to be completed and Government released from the monopoly -- the ministry with this instruction provides an endless life span for this company, respectively.
Instead of the Ministry of Infrastructure taking care of your interest, she uses the entire creativity to maintain the company's interest that has a monopoly for ten years on the market. So the introduction of other operators to the market under this administrative instruction depends entirely on the will of the company, which has its counterparts. Article 7 of this administrative article is in full opposition to Article 119 of the Constitution of Kosovo, which says, actions restricting competition through the abuse of dominant positions or practices limiting competition are prohibited unless these are allowed by law. This directive is also contrary to the 05/L132 law, from which, by the end of”, Bajrami said.
MP Bajrami cited countries in the region where counterparts conduct several companies, such as Britain, in which there are 40 companies performing their counterparts, in Montenegro there are 7 companies.
