According to the audience, the municipality has leased 61 municipal properties for temporary exploitation, bypassing the public auction process as well as determining the price of rent in these cases has not been made in line with Rule No. 23/2013.
This year's “, 36 municipal property users, have paid no rent at all, and the municipality has taken no action to register these means. Moreover, in 11 cases the contracts for property exploitation were not valid, since it has expired the contract's deadline. Only on one occasion during 2017 has the contract been continued to exploit property by being summoned to the old law, which had long been abolished”, the Istog Commission audit reports, writes the news.
Therefore, the audience has shown the danger that identified weaknesses can result in limited or less competitive competition from this category and not equal treatment of the parties in the case of voluntary price definition. “The lack of control and no application of adequate measures cannot collect revenues from rent and increase the risk of streaming requirements. Also operating with expired contracts deprives the municipality of the right to collect revenues and prosecute judicial procedures in cases of no long-term debt inflowing”, the audience says.
According to the media report, Istog Mayor Haki Rugova at the end of his term, in 2017 he was planning to reward the company of his brothers “Macon”, with the provision of 5 hectares of municipal land in Istog. In addition to his family company, Rugova had planned to reward several other companies with providing municipal land for exploitation.
This had led PDK, AAK, Vetevendosje and an independent candidate to launch the assembly, causing the municipal assembly to have no quorum and cease.
Campaign contracted
But, according to the audience, last year's Istog municipality had seen to sign funding-free contracts during the election campaign.
According to the audience, in two cases the municipality has signed contracts at the end of the year without budgeted funds for the coming years. The contracts: “Asphalmation of the local Selmon Tahirsila Road, village Lluga” with 29/11/2017 with a 60-day dynamic plan, as well as “Betoning the Vrell irrigation channel 'Pgode” with 13/11/2017 with a dynamic 50-day working plan. According to the audience, according to the budget Law requirements, no signing of contracts at the end of the year for projects, whose expenses are expected to take place in next year. Disfellowshipping is only the case when the budget for such a project is planned for years to come.
“contratrates for projects that cannot be completed in the current year and potentially will have an unplanned spending in next year, increasing the risk of total failure of the project, or increasing uncovered commitments”, has shown the risk of auditing.
Pay Without Enough Witnessing
During the testing of payments, the audience has come to terms that in the following two cases, payments were made without providing enough evidence for performing services:
The payment worth 638euro, for “The creation of unified address system in the Istog municipality” has been realised without evidence of service realisation; and the payment worth 15,000 euros for “Okayed the fourth local order roads in the Istog municipality” has been realised on the report prepared by the commission for performing jobs, according to which the company has made it across the roads with a variety of municipalities, but which is not exactly indicated as the road and the amount of jobs carried out.
“Pages in lack of evidence or definition of jobs, accepted services increase the risk of payment in lack of supply or supply not in line with the contract. This could also affect budget damage”, while recommending the mayor of the municipality to strengthen controls in the payment process to ensure that the payments will be realised only after providing sufficient evidence for performing contracted jobs/services.
Entrance without budgetary means availability
The municipality has started building 10 houses under the “Home Construction Project for Homeless People in the Istog municipality”, exceeding the available budget of 95,000 euros. The contract signed with 13/07/2017 stipulates only the price for units/house worth 10,679 euros, but does not specify the number of houses to be built.
“Access to budgetless obligations is contrary to the LMFPP, and increases the risk of the municipality paying penalties on delays, thus causing budgetary difficulties for the next years”.
The audience has given 16 recommendations to Istog's municipality regarding the findings.
