The new code currently specifically includes the action “sexual abuse“, which is not included in the current Penal Code.

According to the new Code, anyone who sexually molests the other person, particularly the person who is sensitive because of age, illness, disability, addiction, pregnancy, severe physical or mental disability, is fined or sentenced to imprisonment for up to three years.

However, sexual harassment according to Article 183 paragraph 2 implies any form of unwanted verbal, nonverbal, or physical behavior of sexual nature, with the aim of violating dignity or violating one's dignity, and creates an environment that is objectively frightening, hostile, degrading, or degrading, reports www.kallxo.com.

While paragraph 3 of the upper article states that special punishment is set forth for the perpetrators of this criminal act by the person who is a teacher, for those who are religious leaders, professional health care professionals, the person entrusted with the growth or care of such a person, or in some other way has a position of authority over that person.

In this case, the perpetrators are sentenced to imprisonment of six (6) months to three (3) years, reports Kalxo.com.

When the offense of sexual harassment is carried out with the use of weapons, dangerous means, or other items that can cause serious bodily injury or serious mental or physical health damage, the offender is sentenced to imprisonment of (1) up to five years.

The criminal procedure for this article's criminal offense is initiated under the proposal.

The new Penal Code of the Republic of Kosovo is expected to enter into force on 1 January 2019.
