Prosecution expected to launch investigation into 13-year-old mother-in-law

The birth of a baby from a 13-year-old minor mother is considered to be enough grounds to open cases in the prosecution. Even the State Prosecutor's Office is expected to launch investigation into the case soon.

The minor who brought the baby to life is a citizen of Albania while living in Gjakova. The woman at Ginecology Clinic has claimed to be married, even saying that the baby's father is a minor.

The director of the Gynecological Clinic, Mirvette Pacharada, has announced that the mother enjoys full health and that the child has been brought to life in the 33rd week of pregnancy.

It is in full good condition, even though as a doctor we are obliged to present it to the high-risk birth group, but fortunately it has gone well. But as a gynecologist, we don't prefer to be born before we are older, when the law envisions the age for birth, for all. Meanwhile, Neonatology Clinic Director Jevdet Goynovci said that the birth took place on Monday at 10:15 minutes. Currently because the baby was born prematurely, it is found in an incubator but is in vital stable signs.

Lawyer Florian Dashi says the State Prosecutor should begin investigations into the case, as according to him the publication of the news that a minor has become a mother, provides sufficient grounds for investigation.

In a concrete case, I think that the very publication of the news, the fact that the person in question is a minor, according to what we've understood from the media has only 13 years, is enough basis for competent organs to begin investigating, because there is grounds for doubt. Let the investigations begin to clarify all the circumstances associated with this case and to look into the finals whether this case eventually or this is a criminal offense. To see them explain, who is the director of this work and ultimately the bodies that are called for it, in this case the State Prosecutor to see if there is a criminal offense in this case”, he said.

According to information from the Gynecological Clinic, the baby's father is also a minor, indicating whether there are legal provisions that punish him if he is found to be an adult.

“Codi Penal Code regulates in the sense that if the people in question are of the same age or relative age, I would call it a difference of more than two years, then it is no criminal offense. But, however, to clarify all these dilemmas I think the investigation should be conducted and to see what the chief, which age belongs to the owner. It may depend on the circumstances under which it was carried out, because there are many provisions of the Kosovo Criminal Code that regulate and determine the extent of the punishment depending on the circumstances under which it was carried out, starting with rape, then cheating, the promise of marriage. By the State Prosecutor, Prosecutor Ibrahim Berisha, has indicated there will be no investigation whatsoever.
