Judgment against Sokol Bashata postponed

The reason for this session's delay was that state prosecutor Zahidje Gashi, with his letter to the tribunal, has demanded that construction expertise be made.

Regarding this prosecution proposal, defenders of the accused had remarks, and the same demanded that financial expertise be made rather than construction.

The defender of the accused, Sokol Basota lawyer Guzim Kolcaku, said such expertise is not relevant to the fact that the price of rent given is set by the Municipal Assembly and there is nothing contesting the rent and that they have had no contribution to determining the height of the rent.

Other defenders of the accused also rejected the prosecutor's proposal Zahid, arguing that those dwellings were not built for the purpose of selling or profiting from them, but exclusively for administration workers.

The state prosecutor states that since the height of material gain has been disputed, then I propose that financial expertise be made for the level of the payment set by the municipality, benefited by the accused, counting on market prices and the time when these works were done.

While Chief Justice Syle Lokaj after consulting with members of the body Sami Shardaku and Sejdaj Blakaj, approved the proposal to become a financial expertise, so the court will send the material papers to the financial expert.

Meanwhile, past judgment had failed because the prosecution was not prepared to defend the indictment against the accused.

According to the indictment, Sokol Basota, Enver Berisha, Esat Racci and Fadil Gashi in co-ordination have committed the criminal act of misuse of official office.

They are charged that during the process of renting residences owned by the Kline municipality, they have made political agreements that at least 6 out of 10 residences owned by the Cline municipality set a price for self-freeness and for exhibitors of their political parties, bypassing applicants with serious economic situation.

On the former head of the Cline municipality, Sokol Basota and accused Enver Berisha are also burdened by criminal acts “mos-reporting why false property reporting”, since, according to the Prosecution of January 2009 until June 2016, they have not included data or information when they presented their property statements to the Anti-Corruption Agency.

The accused were acquitted of charges charged.
