Jamsit Ajvazi in 1993 was killed in the presence of his family from Enver Islami. The killer fled to Spain, where he also committed a double murder. Now, it is demanding that the sentence on him in Kosovo be reduced, having pleaded guilty.

Enver Islam was sentenced for the murder of Jemshi Ajvaz in 1993. Shortly after the murder, Islam fled to Spain, where it also committed double killings.

In 2016, Spain deported it to Kosovo, and the court process against it immediately began in Kosovo. In 2016, Enver Islam from Potoku of Podujevo was sentenced to 15 years in prison, but the victim's family had not been hired.

During the trial, Islam pleaded guilty to killing Jemshi Ajvaz, but did not agree to the sentence pronounced for 15 years in prison.

Now Islam complained to the Constitution after claiming to have violated their rights, but it did not succeed in this court either, after his request was rejected. But the victim's family, the Ajvazi family, had sought the opposite, narrowed the sentence to Enver Islam.

The Constitutional Act that Express holds against this case shows the reasons for Enver Islami's refusal to request a reduction in condemnation and for rejecting all previous judgments.
Against the first - degree decision, the Ajvazi family had come out with a complaint on the second scale. They demanded that Enver Islam be pronounced the highest prison sentence.

So did Islam in the Appeals, demanding that the sentence be reduced after he was pronounced the ultimate sentence in force at the time of the work's performance, and that the Court, according to him, has not considered admitting his guilt as a facilitating circumstance.

In January 2017, the Court of Appeals decided to confirm the sentence the Constitutional Court of Enver Islam had pronounced, rejecting the demands of both sides.

Islam, which pleaded guilty to Jemshi Ajvaz's murder, also applied to the Supreme Court to change the verdict on criminal sanctions and pronounce him a more mild prison sentence. This third degree of trial also rejected his request as unfounded.

After closing the door on all previous courts, as the only opportunity to drop years of condemnation, he also saw the Constitutional Court of Kosovo.

By the Constitution, Islam demanded that the sentence be eased was received in advance by the Founding Foundation, and rendered nullified acts of intent, turning his case into retrial.

Thus, Islam demanded from the Constitution that the Supreme Court's act, which rejected its request for protection of legitimacy, be rejected by this court, but even here, proved unsuccessful.

In the Constitutional Court's decision of December 14, 2018, it has been decided that Enver Islam's request is unacceptable, that it has not clarified which rights and freedoms it claims were violated by the Supreme Court's conviction, even by not clarifying the facts and claims of constitutional rights violations, the newspaper Express writes.
In September 2015, Pristina's Foundation Court had announced that after committing the murder in 1993 and fled to Spain, this state deported it to Kosovo.

The founder had said that the defendant had been on prosecution by then authorities exactly from the District Court in Prokuplje, which until 1999, according to the Republic of Serbia's decision was appointed with painful and territorial competence for the Podujevo Community.
According to the Pristina Constitutional Prosecutor's Act 23 years ago, exactly on April 28, 1993, around 19:30, on “Street. Skenderbeu”, from postcrupulous vengeance Enver Islam deprives the late James Ajvazi of life.

Always according to the indictment, Islam had fired four shots of an unidentified weapon, while one of the bullets has now fired the late James, who had changed lives later in KKUK in Pristina, reports Express.
