The projected value for this tender is 2m of 441m euros. Meanwhile, in the contract announcement, the Ministry of Infrastructure has published only one price for units of the company “Arbotec” S. P.K of 94.94 euros, which was recommended for the contract.
This decision was taken after complaints by operators “Damastion Project”, sh.p.k & “via Egnatia” sh.p.k. “NT US Zahiri” & “Beni Com”, which have been partially approved based.
Operator options “Damastion Project”, sh.p.k & “via Egnatia” sh.p.k. “NT S. Zahiri” & “Beni Com” as disgruntled parties in their complaints have claimed that the Ministry of Infrastructure has acted in opposition to some provisions of the Law for Public Procurement.
The contractor's “Autority has acted in opposition to 1, 7, 13, 51, 56, 59, 60, 63, 66, 67, 69, of the Law for Public Procurement of the Republic of Kosovo”, says in the complaint of “Demastion Project”, sh.p.k & “Egnatia” sh.k.
In the complaint of the other economic operator, however, AK has reportedly acted in opposition to articles 10, 38, 59, 61, 108/A Public Procurement Law.
While holding O session KPS, encryption operator “Damastion Project”, sh.p.k & “via Egnatia” sh.p.k. did not agree with the review expert's report, saying they were not taken on all their complaints.
Save, and “NT US Zahiri” & “Beni Com”, stood by the expertise report since their points were all mentioned by the expert.

“The AK has violated Article 10 paragraph 3 of the LPP, because OE complainer by the date 13.08.2018 has sent e-mail to the contracting authority for access to the tender documentation, but the contracting authority hasn't returned any answers to the economic operator”, the decision says.
The review panel had come to the conclusion that the examination, assessment and comparison of the tenders had not become a contractual Nent 59 of the LPP and that the 60th provision of the contract was not respected, which was the lowest-priced irresponsible tender.
The contracting authority is therefore imposed on the contracting authority to re-evaluate the bids and in the future keep in detail all the LPP provisions and the tender file requirements and report the contract and at the same time respect the LPP Article”, the decision says.
