Towards Prime Minister Ramush Haradinaj's decision to sack all members of the State Council of Quality and the director of the Agency for Accreditation has also reacted to Mirlinda Batalli, former member of the KSHC.
Batalli has said she feels insulted for her labeling and all members of the Council as competent “, without academic and ethical credentials”, as she has said she is a professor of the Faculty of Jurydic of the University of Pristina and has long experience in the academic and judicial field.
Despite this, I have to say that I am surprised by the very flawed and confused reasoning of two lines, the decision of the Ministry of Education, which does not contain any findings of the actual state of law. Such reasoning about the dismissal of an independent council is not at all professional, and, above all, is not accurate and argued”, says Batalli's response.
The decision in question does not refer to Article 7 of the Law on Higher Education No. 04/L-037, which determines how the appointment of KSHC members is made, as well as the reasoning it takes to make it in the country if it requires the replacement of a third of the Council members for any reason within a year. I'm curious to know how I'm going to reason with the minister before the Assembly dismissal of all KSHC members. Moreover, I'll be curious to convey how the appointment of new members of this Council will be made, including 3 internationals, to operate the agency's work.

Batalli said he cannot mention the fact that the legal basis of the Minister of Education's decision to sack KSHC members refers to Article 8, point 1.4, of the Law on Higher Education of the Republic of Kosovo, which actually does not exist at all, because Article 8 of this law does not contain the 1.4. And even more, this article refers to the public carriers of higher education!
This huge legal release in a decision as serious as this for the dismissal of all members of a special state-owned Council in Kosovo, makes no excuses at all, and can easily be the object of judicial interpretation before competent bodies. Administrative Guide No. 092017 of the date 02.09,2017 to which the minister refers on the legal basis of this decision was unable to find it, and I am very interested in knowing what this directive has established as a legal basis for the dismissal of KSHC members” is said in response.
