Only six months after the appointment at the head of the Appeals Court Hasan Shala is no longer chairman of this Court.
Kosovo's Constitutional Court has declared the Kosovo Judiciary Council's decision to elect Hasan Shala to the head of the Court of Appeals invalid.
The Constitution has found that the Judiciary Council has violated several provisions of the Kosovo Constitution when it has decided that Hasan Shala would vote for the chairman of Appeals. Article 24 has been violated for equality before the law, Article 31 which stipulates the right to fair and impartial judgment, as well as Article 108 for the Kosovo Judiciary Council.
Shala through a communique for the media has announced she is no longer in office.
I thank the Court judges that Appeals, administrative staff, constitutional institutions we've had cooperation with, donors, non-government organisations and media for excellent co-operation, over these 6 months”, Shala has said.
Shala expects the KDR, very soon to carry out its obligations in relation to the Constitutional Court's act and to continue with common goals, for a judiciary, independent and impartial, efficient, transparent, reliable and accounting.
