The decision concerns two Afghan families and a Syrian applying for asylum after leaving Croatia.
The European Union Court said it is the responsibility of Croatia's state to decide on their cases.
The migration crisis emerged during the summer of 2015, after one million immigrants and refugees invaded the Western Balkans.
Under the so-called Dublin regulations, refugees should usually seek asylum in the first state of the EU to arrive. But Germany suspended Dublin regulations for Syrian refugees, <x0 reported BBC”, report Periscope.
Since August 2015, hundreds of thousands of people arrived in Austria every day, originally through Hungary and later through Slovenia.
Many wanted the state in Germany more, but about 90,000 wanted asylum in Austria's state, equal to 1% of its population.
Afghan refugees were rejected by Austria.
Among them were two sisters from Afghanistan, Khadija and Zainab Jafari, and their children, who reached the Austrian border in February 2016.
Austrian authorities decided that they would be deported to Croatia.
