Court reduces sentence to members of I SIS (Document)

On the morning of July 11, 2015, Kosovo police had initially arrested three people at Badovci Lake, and then two more, under suspicion that the same were preparing terrorist acts in the name of religion. Faithful Latifi, Gazmend Haliti, Milazizim Hadziaj, Fehmi Musa and Enis Latifi were tried by the Court [...]

Faithful Latifi, Gazmend Haliti, Milazizim Hadziaj, Fehmi Musa and Enis Latifi were tried by the Constitutional Court in Pristina, where they initially received the total sentence of 49 years, but the Supreme Court then turned the case into retrial.

The Supremee did not agree with the original legal classification.

While after the retrial, the sentence was clearly reduced for 31 years, and the group will now serve only 18 years in prison for the work done.

The court, despite numerous evidence provided by the police and prosecution, declassified the sentence originally handed down in the case known as “Bavci”.

Indexline has provided evidence found by the investigative bodies about the case and, as such, publishes with part of the indictment filed by the prosecutor, Drita Hajdari.

A year after the group's arrest, the Constitutional Court in Pristina had handed the verdict on the five accused in question of preparing terrorist acts.

Under the court's ruling, Besnik Latifi had been sentenced to 13 years in prison, Gazmend Haliti to 12, Milazim Hadziaj to 10 years and 3 months, Fehmi Musa to 4 years and Enis Latifi to 10 years in prison.

Case prosecutor Drita Hajdari had declared that she stands near the established indictment and that she is convinced the accused have committed the deeds they are accused of, so she had demanded their sentence.

The charge, which was fully secured by Indexline, shows that the five accused in July 2015 had gone to Lake Badovci, near Pristina, in order to record a propaganda video in which they planned to read the oath to the leader of the terrorist organisation “Islamic State”, known by Short I SIS.

The group, according to the Prosecution, has aimed at publishing this video online in order to testify to the world's scope of the so-called “Islamic State” in the Republic of Kosovo.

Meanwhile, surprisingly, the decision is made to reduce condemnation at a time when the US has consistently warned Kosovo and the Balkans in general of risking our country from terrorism.

But ten months later things changed after the Supreme Court decided that this case would become a retrial. After holding several hearings, the court reduced the sentence for 31 years to five accused. Faithful Latifi was sentenced to four years and six months in prison this time, Gazmend Haliti, Milazizim Hadziaj and Enis Latifi to 3 years and 6 months in prison, and Fehmi Musa was sentenced to 3 years in prison for help in carrying out the criminal work. Occasional prosecutor Drita Hajdari had known that this time it would be decided differently from the first time, so she missed the hearing where the indictment was declared.
