They have been named as vain and naive, as they say, the efforts of the ruling political subjects, which on Friday, have twice attempted to send before the Parliament's deputies the proposal to abolish the Law for Specialised Chambers and the Special Prosecutor's Office.

But, in view that this law was adopted by the Parliament of Kosovo, even with much controversy and controversy, especially opposition parties, what is the motive for abolishing this law?

Politologist Belul Beqa, professor of Political Sciences, speaking of Radio Free Europe, fully appreciates the efforts of the ruling parties to abolish the Law for the Special Court.

They've been thinking of putting pressure, blackmail. They have used veterans to be an instrument for destabilizing the situation, to show that they are factors who can still control the situation, and so on, before the international community. This, in order to enable negotiation, so that someone can save it easier or advance it, but later. Their philosophy has been naive and I believe that inaction must be over, because even after 18 years our court has done nothing”, Beqa says.

Artan Mujariri, political affairs analyst, says political leaders have not had to be launched in, as he calls them, adventures that harm the country, if they themselves had basic knowledge of how international courts process works.

The “should have known that there can be no deviation from this justice, especially at this stage, so at this level, when the clear contributions of the Special Court's process are seen, with judges, with field work on collecting evidence and with the beginning of the date of the first executions. So it was a totally naive act”.

Politologist Beqa, the opinion that the attempt to abolish the Law for the Special Court implies the attempt to empower those subjects and factors, which, he says, have brought Kosovo before failure.

Kosovo's “state will speed up the path towards failure if in this case it shuts the door to international justice. I think it's the national immature if citizens are subject to the dictatorship of individuals and groups who are trying to defeat the state, because they have potentially seen themselves as suspects by the Special Court. Finally, I think that, in reality, while the potential perpetrators of alleged crimes are at large, there is no sovereignty and freedom of actual action in Kosovo”.

Meanwhile, analyst Muhaxhiri considers the thought of access to international justice absurd.

I don't understand what the motive was, because it's completely incomprehensible that even if it was the plan to get away from international justice, that it would be done this way. So far the international community has given clear evidence that the Special Court project is a project that it will invest money, quartdro and time. So it is absurd to think that by a simple vote of the Kosovo Assembly, the entire major international project” will be annulled.

However, the attempt to send the proposal for abolishing the Special Court Law to Kosovo deputies has sparked numerous reactions from ambassadors of Western countries to Kosovo, but also civil society.

Recently, Kosovo's Institute for Justice (IKD), which has praised that the initiative to undo the Special Court seriously violates Kosovo's international obligations, conflicts with international values and principles regarding the rule of law that Kosovo has pledged. As a communiqué for the IKD's opinion states, this initiative “strongly coincides with the international judicial subjectivity of the state of Kosovo”.

This step, if realised, eventually shows that Kosovo lacks the ability to enter contractual relations with states and international organisations as a result of failing to implement the same international agreements it has pledged to implement in a solemn and written manner. This step, if realised, also represents serious violation of international law, something Kosovo dares and should not allow itself if the unconsolidated status of Kosovo citizenship is considered”, it has said. IKD.

However, Kosovo Prime Minister Ramush Haradinaj, on Saturday, has again named the Special Court as the unfair “” for Kosovo, while Kosovo Parliament Speaker Kadri Veselini has estimated that what happened on Friday was “proces that have been developed in the context of the country's laws and political positions of each subject”.

However, he has made it known that Kosovo's Assembly since Saturday has been introduced into winter recess until the third week of January.
