Cadman for the process at The Hague: Crossed on July 20th, GEDN's decision affects Appeal

Nasim Haradinaj's lawyer, Toby Cadman, has spoken of the possibility of an eventual decision by the European Court of Human Rights that is taking place at the Special Court in The Hague.
On show “Info Magazine” in Klan Kosova, Cadman said any possible decision in favour of Haradinaj would depend on court judicial reasoning and consistent violations, Periscopi broadcast.
According to him, the only tool the GEDNJ can offer directly is financial compensation for human rights violations, but he added that the impact of such decisions could go beyond the individual case.
“Many things will depend on what the GEDJ decision will say about what Mr Haradinaj has complained about, the only means of action this court can take is financial compensation for human rights violations<1>, he said.
He stressed that such decisions may have broader implications in the way judgments are currently under way, including procedures in the Special Court Appeal Rooms.
But, of course, decisions like these would have much broader implications, such as the implications of how judgments under way are carried out. I also think we should know that there will be no more cases at the Special Court. So there will be no new judgments, but there are still procedures on the appeals scale”, Cadman said.
Cadman added that the impact could have on other cases that are still under way, including procedures to try to prevent justice currently under consideration.
“As we know, the trial in Thaci case and others will be given on 20 July. So even if the European Court for Human Rights makes a decision on Haradinaj's case now, which is not expected, it would have no impact on that case, but it would certainly have impact on procedures near the House of Appeals. Even in this case, for trying to prevent justice that is under way, the lawyer said.
