Two indictees fail, hearings against 12 police officials and two customs officers charged with bribery

In the absence of indictees Sami Hajdari and Enis Turtula, it has failed to hold Tuesday's session at the Constitutional Court in Pristina, against the 12 police officials at the Preush Qafe border supervisory station and two customs officials, who are charged for “Brituring”.

12 police officials charged in this case are: Artan Thaci, Agron Bejtullahu, Afrim Deda, Avdi Peroli, Benon Kupiska, Isa Ibrahimi, Kreshnik Arllati, Mala Berisha, Mehmet Manjuka, Sami Hajdari, Shaqir Krasniqi and Mati Bridge, as well as two customs officials, Ennis Turtula and Senad Zherka, reports the “Battle for Justice<1>.

The defender of accused Sami Hajdari, lawyer Haxhi Millaku, claimed that his defendant has a case of mortar in the family and therefore could not be present.

And the defender of accused Enis Turtula, lawyer Dafina Osmani, said her client is in serious health condition, thus making it impossible for her to attend the court hearing.

The lawyer Osmani proposed that due to its climate procedure and health economy, procedures to isolate itself against him, as the prosecution does not link anything to Turtula and other indictees.

The case prosecutor, Habibe Salihi, said Tuesday's hearing would be postponed, but sought by the Court that indictees who are not present to court remarks.

And the defender of accused Artan Thaci, lawyer Haki Gecaj, said, among other things, that after the criminal act has been committed in co-ordination and evidence is common, according to him, isolating the procedure would not contribute to the economy of the judicial procedure, so proposed that Tuesday's session be postponed.

The defenders of the accused also agreed with the lawyer's proposal Gecaj.

Under these circumstances, today's session was postponed so that the opportunity could be given to all parties to present themselves and be judged together.

In the absence of legal conditions for holding the session, the same was postponed for another day.

At the initial session, held on February 21, 2024, 14 indictees were declared innocent.

In the indictment, provided by “Justice Bettim”, which was established on December 26, 2023, it is said that from August to December 2021, at the Qafe Prush border, the above-mentioned indictees in the quality of official persons have collaborated with each other by taking bribes of various amounts of money.

According to the indictment, the accused-police officials had allowed citizens access to the high border checkpoint, without being subject to any legal procedures in force contrary to the conditions for entry into Kosovo that relate to measures against COVID-19.

While the two customs officers, Zherka and Trutula, are charged that in order to obtain illegal provisions, they had acted in opposition to the Kosovo Customs Code and Actis, allowing the entrance to various goods without being subjected to customs supervision.

In these actions, the 14 defendants are charged with carrying out the ongoing criminal work “Briberging” in co-ordination by Article 421, paragraph 1 related to Article 31 and Article 77 paragraph 1, paragraph 1, paragraph 1, 1.3, 1.4, 1.5 and paragraph 5 of the Penal Code of the Republic of Kosovo. /Betimitor Justice/
