Communists challenge civil service regulations in Constitution: Local Powers Under ban

In the subject expected to be handed over during the following days to the Constitutional Court, the Kosovo Communist Association estimates that the regulation for civil service's accession procedure violates the autonomy of local government and is not in line with the Kosovo Constitution.
Thus, the executive director of the Association of Kosovo municipalities, Saban Ibrahimi, has announced that the issue is discussed at the Council of Mayors meeting held on May 14th.
Ibrahimi for Online Economy said the issue was discussed at the Council of Mayors meeting, held on May 14th, where mayors authorised the Association Secretariat for preparing the course.
The topics discussed at the Council of Mayors of the Republic of Kosovo meeting was also the new regulation 07/2025 for the civil service accession procedure. In addition to the problems municipalities are facing collective contracts, even this regulation was discussed by mayors, and the Council of Mayors authorised the Kosovo Commission Association Secretariat to draft a subject for the Constitutional Court, because the mayors estimated that this regulation is not in harmony with the Constitution of the Republic of Kosovo”, he said.
According to him, the main concern is with Article 4, points 6 of this regulation, where it is envisioned that civil service recruiting procedures be conducted by the Department for Management Public Officials under the Ministry of Internal Affairs.

In addition to certain institutions, in this case it stresses that the scope of this regulation does not apply to the presidency, the Constitutional Court, the justice system and the Assembly of the Republic of Kosovo. So, municipalities are not involved, and based on the experiences of the mayors during this short period of time, this regulation has begun to affect the municipalities of the Republic of Kosovo”, Ibrahim said.
He added that association and municipal representatives consider regulation contrary to the European Charter for Local Self-Government and the law for local self-government.
And we appreciate that this regulation is not in harmony with even the European Charter on Local Self-Government, where our Constitution has taken many principles from this charter and distributed them to the Constitution of the Republic of Kosovo in terms of local autonomy. Also, the central level can only review the legality of acts derived from municipalities in the Republic of Kosovo, but not make decisions for civil servants at local level”, he said.
Ibrahimi made it known that a municipality, on behalf of all Kosovo municipalities, is expected to hand over the course to the Constitutional Court over the coming days.
All municipalities in the Republic of Kosovo have departments or units where they have staff chiefs and they have always in the past developed procedures for recruiting civil service at the local level. So this with automatism with this regulation is taking over competencies and this tendency of central centralization is not now. The mayors assessed that it is good to address this issue at the Constitutional Court in order to make the right decision in terms of this problem”, he said.
