According to the Order, the court would have to make a decision within this 90 day, yet a specific date for the final decision has yet to be set.
So confirmed for Express Special Court spokeswoman Angela Greep.
The correct “date for declaring the verdict in Thaci case and others is not yet known, but the public will be announced when judges set a” date, Greep said.
She has ruled out the possibility that the judges can take extra time beyond 90 days if something like that is necessary.
The time limit for reaching a decision is specific in each case. The rules specify that the Judicial Chamber can extend the reviews beyond 90 days when circumstances require more times”, Grieep has posted.
The 90-day deadline for making the decision is set under the 159 Rule of Specialised Chambers and extra time, except for extreme cases, cannot exceed 60 days.
The first instance is declared within ninety (90) days of closing the case, in accordance with Rule 136, and may include a decision under Article 22K7. When circumstances in the matter require additional time, it should not pass sixty (60) days unless further duration is absolutely necessary. The decision on duration should be public and reportedly to parties and representatives of the victims. Reasons must be given for the duration”, said the Special Court Order.
According to these regulations, the first degree Act, or a summary of it, is publicly announced in the name of the people of Kosovo and in the presence of the accused, unless extraordinary circumstances argue his or her absence.
The first degree of judgment should be in writing and contain the reasoning for finding the panel, until, in the event of release from the prosecution, the trial can be pronounced orally followed by written reasoning as soon as possible.
The KLA's four continue to be in custody at The Hague since 2020 since the Special Prosecutor has filed charges against them. In concluding words, defence teams have sought release from all charges for Thaci, Veselin, Krasniqi and Selimi.
