The Court of Appeals turns case “Brezovica I” into retrial

The case known as “Brezovica 1” has been turned into retrial by Apel with charges of Dragomir Milosavljevic, Hysni Bajrami and Labinot Vitija. According to Appeals the Foundation Court in Ferizaj, it only described the evidence without analyzing it. “From the content of the reasoning, it turns out that the first degree court has made only a general description of the evidence [...]
“From the content of the reasoning results that the first degree court has done only a comprehensive description of the evidence administered during the trial, without specifically analyzing them, has not made the necessary interconnection between concrete evidence and constituent elements of the criminal work, not explaining in what way from each administered trial has come to an end for the existence of objective elements and subject of criminal work for each of the defendants except”, the Appel's decision, reports “Betim for Justice<3>
The founder in Ferizaj on 4 July 2024 accused Dragomir Milosavljevic and Hysni Bajrami of using office or official authority had sentenced them to one year in prison in a single manner and to additional condemnation of the exercise of office in public administration or public service of 1 year, while Labinot Vitija was sentenced to 1 year in prison for criminal work, degradation or environmental degradation.
In this case, Gentian Soula is also being accused, but he is being tried separately against three others.
