In the Appeals, defence requires retrial for war crimes indictee, Sacir Lutvija the Prosecutor's Prosecution

The Appeals Court on Wednesday has held the college hearing of judges in which complaints of defenders of war crimes indictees in Prizren, Shacir Lutvija, lawyers Jovana Fiipovic and Nedmend Sejdiu have been filed against the Constitutional Court's decision in Pristina, which has sentenced Lutjova to 10 years in prison, as [...]

The college of judges who judges this case in Appeals are the chairman of the Ferit Osmani College, the referred judge Mentor Bajraktari and member of the court, Albina Shaban-Rama, reports “Justice Vowtim”.

We remember that the Constitutional Court in Pristina on November 11th 2025 had convicted and sentenced Lutjija to 10 years in prison for war crimes in Prizren.

Judge Bajraktari said that the complaint against the Foundation's decision has filed Lutjeta's defense, while responses to the Special Prosecutor and Prosecutor's Prosecution through the parliament.

Presented to elaborate Apel's prosecutor's parade was Prosecutor Sebahate Hoxha-Pepaj, who said she supported the response to the special prosecutor's complaint, who has demanded that the foundation decision be confirmed, while the complaint of the accused's defenders is denied.

The other side of the defence complaint was presented only by lawyer Sjediu, who said that in the first degree ruling, there is a contradiction and that he has not been able to prove that the accused Lutvi has participated in causing injuries to the injured.

On the other hand, Sejdiu said no documentation exists that confirms the serious bodily injuries that the injured claim were caused by the accused.

According to the lawyer, since the phase of the investigation, there have been violations and more specifically to Lutjija's identification phase on the part of the injured, marking and not respecting the relevant legal standards for identifying suspects for a criminal offence.

In the end, Sejdiu said the tribunal should approve the complaint, amend the first degree ruling in favour of accused Lutvija or the case return to restoration.

On the other hand, Lutvija himself denied that he was part of crimes allegedly committed, saying he was not present and that he is being confused with another person who also has a mark on his face.

The injured Sefer Ejupi and Vehbi Velija said they joined the prosecution and that they did not submit property-juridic requests. At the same time, the other injured man, Fahredin Jakupi, sought life sentence for Lutville.

“What compensation, compensation I am that, life sentence”, Jakupi said.

Meanwhile for Lutvije's defender, lawyer Sejdiu, the injured Jakupi said he is protecting Milosevic's “colat”.

“The evidence has now brought protection to Milosevic's gelatin, this man of Serbia”, Jakupi added.

At the initial session, held on September 17, 2024, Lutvija was acquitted of being charged.

The Special Prosecutor of the Republic of Kosovo on September 4th 2024 has filed charges against Shaqir Lutjija, who is charged with the quality of inspector and police at the Prizren Police Station, individually and in co-ordination with other persons of Serbian police forces during the 1998-1999 period in Prizren, during wartime in Kosovo, has been practicing the depressive measures of murder, arrest, beating, torture and inhuman treatment.

The Actakuz says that according to witness testimony: Murat Kabashi, Elmi Gashi, Sefer Ejupi, Vehbi Velija, Kemajl Kolari, Uke Kolgeci, Haxhi Gashi, Safet Gashi, Hasan Shala and Arsim Zuba, accused Lutvi from 28 September 1998 to 7 October 1998, in association with other members of police forces, have undertaken a campaign for their arrest in Prizren prison, in the quality of the Albanian national population, among them: R.J., and the tall ones.

Always in accordance with the indictment, Serbian forces after the arrest were sent to the Prizren Police Station, on whom the accused Lutviija, along with the other defendants, in the quality of the inspector of this station, questioned the injuries and during the interrogation process have beaten them with boxing and kicking, with other strong means and other methods of inhuman treatment.

In the indictment, Lutvija and other defendants reportedly used electric power tools, which they placed on their hands and on their genital organs, with céçkarst as a result of this R.J., had died, while Murat Kabashi, Elmi Gashi, Sefer Ejupi, Vehbi Velija, Kemal Kolari, Uke Kolgeci, Haxhi Gashi, Safet Gashi, Hasan Shala and Arsim Zuba suffered serious bodily injuries.

With this, Lutvi is accused of committing a joint criminal act “war crimes against the civilian population” by Article 142 concerning Article 22 of RSFJ's Criminal Law. /Periscope
