The accused of killing a knife in Hyvalya in 2021 is sentenced to 20 years in prison

Shkumbin Kryeziu, charged with the death of a knife in Hyvali in 2021, was convicted by the Pristina Court and sentenced to 20 years in prison.
Kryeziu is accused of having joined a minor following earlier disagreements with the late V. J., in order to deprive him of life, he has been stabbed with knives and, as a result of wounds V. J., he's dead.
In this case, Kryeziu has been sentenced to 19 years and six months in prison for murder in co-ordination and for carrying out 1 year imprisonment. He was given a unique sentence of 20 years in prison.
Presented during the plea was not the defendant.
The Constitutional Court in Pristina, in 25.07,2024, had sentenced accused Shkumbin Kryeziu to 20 years in prison for the case, while the Court of Appeals had turned the case into retrial.
This criminal case in the retrial has been handled by the court consisting of Ertan Saylula (head of the Court) and the two members, Fatime Drimak and Naser Foniqi.
Regarding this criminal case, the prosecutor of the case, Arben Hoti, in the final address in the first judicial review, had made a redeployment of the criminal act from “serious murder” to “suicides in co-ordination”.
The prosecution had made this review based on the Supreme Court's act of judgment, under which the Court, acting on the request for the protection of minor legitimacy ( charged in the procedure for minors as co-chairman of this criminal act), had approved the request.
It had further amended the act of the Court of Appeals and the Constitutional Court, with which the minor as a co-chairman was first tried for the criminal act “severe murder in co-ordination”, but according to the Supreme Court's judgment, it had become a resultation of this criminal act in “the genocide”.
On the basis of this, the prosecution had considered that since it has to do with the same criminal conduct committed in co-ordination, the redecoration of the criminal act has a binding character for defendant Shumbin Kryeziu.
Another procedure has been conducted against minors and sentenced.
What does the indictment say?
According to the indictment set up on 29.12.22, at 10,12,2021 around 21:15 in the village of Hyvali, after descending from the late V.J. bus, along with witness Cameron Pacolli, on his way home on the shortest route, he met with the minor in the schoolyard, where the witnesses Gojart Sejdiu and Mirsad Hajoll, who had been verbalised. At that moment, the minor had pulled out the knife, and the defendant Shkumbin Kryeziu, who had stabbed the youngest together, had followed the deceased.
According to the indictment with the deceased on the run was witness Mettim Pacolli, where the witness was shot down, while the defendant and the minor have already pursued the deceased and both with two knives in hand of unscrupulous revenge, due to some earlier disagreement, stabbed him in the body of V.J., who because of the wounds received in the body died at QKUU.
With this the defendant, Shkumbin Kryeziu and the minor have committed criminal acts “serious murder”.
According to Prosecutor's File, defendant Shkumbin Kryeziu is also charged with “possession without permission”.
