Presidency: The decision confirms Osmani has made no constitutional violations dealt immediately with the new session

The presidency's response reportedly confirmed the legal arguments presented by the institution, also clarifying the constitutional deadlines for the president's election.

Under the decision, the 60-day deadline must be completed before that 30-day, considered final and binding.

The presidency points out that in no part of the indictment is found violations on the part of the President, rather, the Court has clarified that it is not the decree that leads the country to elections, but that the decision to elect the new president.

The president of the Republic of Kosovo welcomes the Constitutional Court's act in cases no. KO 72/26 and KO 74/26, which confirms the legal arguments submitted by the Presidency to the Constitutional Court about this case, and confirms that President Osmani has made no constitutional violations.
In line with comments submitted by the Presidency, the Constitutional Court itself confirms in paragraphs 153, 155 and 190 that the 60-day term must be consumed before the 30-day deadline set in Article 86.2 of the Constitution, and that this 30-day term before the end of the current president's term is final and binding, and cannot be related.
The court, in no paragraph of its indictment, has ruled out violations of the Constitution on the part of the President. Rather, it has confirmed that it is not the decree that leads the country to new elections, but it is the failure of the Assembly to elect the new president that causes this election process.
The presidency has expressed the same position in comments sent to the Constitutional Court, stating that the decree is simply formalising an existing situation and that it is not the decree, but is the decision's failure to elect the president who leads the country to elections.
Consequently, since the timely non-compliance circumstances have not been in advance with the Constitution of the Republic of Kosovo, the Court has interpreted an disfellowshipped situation that applies to this specific case, clarifying that “in all cases of election of the president in the future, respectively, procedures for the election of the new president, which cannot last more than 60 days, should start ahead and end no later than 30 days before the end of the current president's mandate.” (paragraph 191)
The president welcomes the 34-day deadline given to Kosovo's Parliament deputies on the part of the tribunal and calls on them urgently to fulfill this constitutional obligation.
The granting of this additional deadline on the part of the constitutional court has not been in the competence of the president of the Republic. But it is the President's decree that has paved the way for this important clarification on the part of the court as the sole and final authority to interpret the Constitution.
Political statements about whether constitutional violations also misrepresent the act, but also the extreme politicisation of a situation already clarified by the Constitutional Court: that failure to elect the country's president is of MPs and due to the lack of political will to reach consensus about the president's election.
Instead of such unstable statements, we invite Kosovo's Assembly to set the new session date tomorrow for the election of the new president and to fulfill the obligation for which they have been elected, giving the country stability and security.
