Eugen Cakoli from the Kosovo Democratic Institute estimates it is expected that the Constitutional Court will declare President Vjosa Osmani's request regarding the composition of the Central Election Commission unacceptable.
With this, this topic is among the tribunal's most treated and leaves no room for new artificial dilemmas. This concludes the attempt once again to turn this into a constitutional dilemma. Rules that exist and have been implemented in identical situations in the past must be applied again. The idea that the CEC should reflect the mandates report as the Parliament is wrong and incompatible with the institution's constitutional design. The CEC is not a miniature of the Parliament that reproduces the political forces report. For this reason, its composition is not designed to reflect the dominance of a subject, but to maintain a balance that keeps the electoral process reliable”, Calcoli wrote on Facebook.
He has called on the president to complete the completion of the 11-member CEC composition.
Therefore, the president must complete the completion of the 11-member CEC constitutional composition as soon as possible, naming the remaining member from the ranks of the other political subject fairly nominating”, Calcoli wrote.
Kosovo's Constitutional Court has declared President Vjosa Osmani's request for clarification on the issue of appointing members of the Central Election Commission.
Osmani had called for the assessment of “conflict between constitutional competencies”, between it and the “parliamentary groups as Kosovo Assembly troops” in, respectively.
It had also called on the recruit to impose temporary measures on implementing legal deadlines regarding the beginning of the mandate of a member of the CEC, who had not been appointed due to constitutional irregularities.
The Constitution has declared Osman's request unacceptable. He has also rejected the demand for the provisional measure.
The constitutional dilemma, as President Osmani's cabinet had said, is because parties have made more proposals than the Constitution envisioned.
